HONOURABL E SRI JUST ICE RAJA EL ANGO CRIMINAL PET IT ION No. 1684 OF 2009. ORDER: This is a petition filed under Section 482 Cr.P.C. seeking to quash the proceedings in Cr.No. 9 of 2009 on the file of the Gospad Police Station, Kurnool District. At the instance of the second respondent/complainant who is an employee of APSHCL, a case in crime No.9 of 2009 for the offence punishable under Sections 353 and 323 of IPC is registered against the petitioner. The grievance of the petitioner herein is that when the complainant stated nothing complaint, Investigating Officer should not file a petition before the Court concerned to alter the charges. It is seen from the proceedings that during the course of investigation of the contents of the complaint, the Investigating Officer was noticed the abusing of the complainant by the petitioner by the name of his caste. In view of the same, the Investigating Officer is at liberty to file a petition to alter the charges if any new material is available. Hence, this Petition is not maintainable.
