5. On considering the evidencc ol PWs. I to 3 and Exs.A 1 to A I 5, I hc Tribunnl held I llat the accrdcnt was c.lused bv the rash and ncgligent driving of the car and also attribLrted contributotl, negligcncc to the cl:rimant. It assesscd the tot.rl compensation.rl Rs.8, t3,000, buL reduccd it to Rs4,06,500 bl deducting 50' towards contributory negligence.

6. Heard learncd counsel for the both sides and perused the rccord.

The learned counsel for the appellant/c laiman t contendc(l that the finding of contributory negligence is crroneous and contrary to the evidcnce on record. tt is further contended that Ex.Al-FIR and Ex.A2-scene of offence panchanama clearl,t establish that the accrdent occurred while the claimant was waitinil beside the road and the car came onto the wrong side and hit the motorcycle.
