Common Order: (Per Hon’ble Sri Justice Goda Raghuram) The challenge in these writ petitions is to the orders passed by the 1st respondent-Arbitrator under the provisions of Section 71 of the A.P. Cooperative Societies Act, 1964 determining the liability of the petitioners the respondent-Cooperative Bank and issuing a certificate for recovery of the amount due as determined in the said proceedings. Sri G.Rama Gopal, learned counsel for the petitioners says that he has no instructions as to whether some or all of the petitioners have already paid the amounts to the Bank as per the Award of the 1st respondent or have settled the disputes with the Bank, out of Court. In any event an appeal against the certificate issued by the 1st respondent lies to the A.P. Cooperative Tribunal under Section 76 of the Act. In the above view of the matter, the writ petitions are dismissed granting liberty to the petitioners to avail alternative remedy of appeal under Section 76 of the Act, in the event the grievance of the petitioners against the Award passed by the 1st respondent, subsists. With the liberty granted as above, the writ petitions are dismissed. But in the circumstances without costs. _______________________ GODA RAGHURAM, J ____________________ N.V.
