BHASKARREDDY - WRIT PETTTION No.3133 OF 2025 ORDER: The writ petition is filed seeking following relief: "... to issue an orcler or direction rnore particularly one in the nature of Writ of Mandamus declaring the action of the respondent No.4 and 5 in interfering into the peaceful cultivation of the Petitioner's agricultural land to an extent of Ac.l-25 Gts in Survey No. 129173 which is situated at Yadagiripally Village, Miryalguda Mandal, Nalgonda District and conducting the Panchanarna on the Assign land of the, Petitioner without issuing any notice and without following the due process of law and without having jurisdiction prepared the panchanatna and threatening the Petitioner to handover the land of the Petitioner to the Respondent No'6 is highly, illegal, arbitrary, unconstitutional ancl violation of Articles 14, 75,21 and 300-A of the Constitution of lndia and also violation of the Principles of Natural Justice and consequently to set aside the irnpugned panchanama tlated 19.02'2024 conducted by the Respondent No.5 which was conducted without issuing any notice and without following the due process of law on the Petitioner's land to an extent of Ac 1-25 Gts in Survey No.l29173 which is situated at Yadagiripally Village' Miryalguda Mandal, Nalgonda District and pass" '"

It is stated that petitioner is the absolute owner and possessor of the land admeasuring Acs.1-25 guntas in Suwey No'129/73 situated at Yadagiripally Village, Miryalaguda Mandal, Nalgonda District. lt is stated that initially subject land was assigned to the grandfather of the petitioner under the landless poor category as per 2 _r -: .ia-, the provisions of G.O.Ms.No.l406 dated 25.07.1958 Aftr:r the death of his grandfather, petitioner succeeded to thr; subject land and requested thr: respondent authorities to mutate his name in revenue records antl issue pattadar passbook in his favour. As respondent Nos.2 and ,4 were not mutating the name of the petitioner in t'evenue records and issuing pattadar passbook, he flled W.P. No.28565 of 2024 before this Court and this Courl, by the order 16.10.2024 <lisposed ol the writ petition, directing respondent Nos.2 ro 4 therein to consider the application of the petitioner for mutation and issltllnce of e-pattad:rr passbook in respect of the subject [and, wit]rin a period ofthree (3) vreeks from the date of receipt of a copy of that order, and thc same is p,ending before respondent Nos.2 to 4 lor adjudication. It is further stated that respondent No.6 with an intention to grab the land of the petitioner, in collusion with respondent Nos.4 and 5 got conducted pirnchanama on 19.02.2024 on the subject land, without issuing any rrotice to the petitioner, stating that the grandlather of the petitionel has sold land to an extent of Ac.0-34 g.untas otrt ofsubject land to respondent No.6. Despite the subject land being the Assigned land responclent No.6 is trying to mutate his name in lhe revenue records. As the Police were also interfering in the disput-es between the petitioner and respondent No.6, petitioner filed W.P. No.24867 of i ! i i I I 3 2024 beforethis Court, and this Court by the order dated 15'10'2024 has directed Police authorities not to interfere in the civil disputes between the petitioner and respondent No'6' It is stated that on the strength of fake panchanama dated 19'02'2024' respondent No'6 has instituted a suit in O'S' No'18 of 2025 before the learned Junior Civil Judge, Miryalaguda, (for short 'Trial Court') seeking bare injunction' Hence, this writ Petition' lt is settled law that when the land has been assignefby 3. following the procedure contemplated under Laoni Rules'1950 and the Policy enunciated by the Govemment in G'O'Ms'No'1406 dated 25.07.1958, the revenue authorities are having power to initiate action for violation of the conditions thereof' by resuming the land into the custodY of the Govemment'

As it is contended by learned counsel for the petitioner that at the instance of respondent No'6' respondent Nos'4 and 5 are interfering with land assigned to the petitioner under the provisions of G.O.Ms.No.1406 dated 25'07'1958, this Court deems it appropriate to dispose of the writ petition, directing respondent Nos'4 and 5 not to interfere with the peaceful possession and enjoyment of the petitioner in respect of the land admeasuring Acs'1-25 guntas in I t I 4 Survey No l29ll3 situated at Yadagiripalty Village, N{iryalaguda Mandal, Na.lgonda District, in any manner. Hou,ever, if respondent No.6 is claiming right over the subject land, petitroner is at libefty to approach the Trial Court and file appropriate application in the suit instituted by respondent No.6 or institute a separate suit against respondent \o.6, in accordance with law.
5. With the above observations, the writ petition is disposed of.
