31. The subject matter in all the Writ Pe1:i -ions pertains to Plots in various Sub-divisions of Survey I'o.36 situated at Gopanpally Village, Serilingampally Ill mdal, Ralga Reddy District. For reference, facts in W.P.Nc 3681 of 2021 are being considered (Serial No.7 in the ratch of writ petitions)

32. It is the grievance of petitioner that rr: ipondents are refusing to receive and register the Agreeme:r . of Sale-cum- Irrevocable General Power of Attorney date C 03.07.2019 bearing document No.433 of 2079 in respecl >f Plot No.287 in Sy.No.36/AAl8 (Sub Division No.S of Sy. ) o.36) situated at Gopanpally Village, Serilingampally I\I rndal, Ranga Reddy District. It is submitted that the docur rent has been 21 JAI(J W.P.No.'1475 of 2021 &batch kept pending on the lile of Sub Registrar on the ground that a notification dated 26.O9.2OL} in File No.ES / a7 K I 2O I 3 / Serilingampally/ Gopanpally issued by District Collector and the letter bearing No.B/322/2OOZ dated O8.O9.2Oll of the Tahsildar. It is further submitted that Sub-Registrar, Serilingampally, refused the registration of document that the scheduled property is prohibited as per the list furnished by Tahsildar, classified as Poramboke.

33. Attention is invited to Ex.P3 a letter addressed to the Sub-Registrar by Tahsildar.

34. It is submitted that order of refusal of Sub-Registrar was carried by way of an appeal before tJ:e District Registrar and the District Registrar vide proceedings dated

17.06.2020 (Ex.Pl) refused registration of the deed on the premise that property in Sy.No.36/AA/8 was included in the prohibited property list vide notilication in File No.Es/4733/2013/Serilingampally/Gopanpally, dated

26.09.2013, issued by District Collector, Ranga Reddy District and as such the propert5r could not be registered. 22 JAK,J W.P \ ,.4475 of 2021 & barch

It is submitted that notification relie,r upon by the Registrar in his order dated 17.O6.2020 is in parimateria to the notification which was the subject matt :r of chellenge before this Court and that this Court in 'vlr P.No.19069 of 2Ol4 by its order dated 25.O8.2014 had dir-, cted the Sub- Registrar to receive and process the rieeds of conveyance subject to the condition that Sub-Registrar rv rs at libert5r to refuse to register the deeds by duly assi5 ning reasons. Placing reliance upon the judgment of the earned Single Judge, it is contended that the said notifrcari rn annexed at Page No.26 being in parimatcria to that of t re notilication under challenge in the W.P.No.19069 { f 20t4, the notifrcation dated 26.O9.2013 has to receive t re same fate.

36. Learned counsel invited the attention o this Court to the document annexed to the counter affic avit filed and submitted that the list communicated bi the District Collector to Commissioner & Inspector Gent ral vide letter No.EL/4a78/2024, dated 07.O4.2025, is a r; rbsequent list and the same cannot be relied upon, as ttr, , order of the Registrar and the Sub-Registrar are basec on different 23 IAK,J W.P.No.4475 of 2021 & batch notification (earlier dated) and letter of Tahsildar. It is submitted that by letter dated 07.O4.2O25, properties are added to a-rrd a revised list of immovable properties is issued and the said survey number finds place in the said list. It is further submitted that reliance placed on a list dated 07.O4.2025 is misconceived and is not valid in ttre eye of law as the rejection orders of both the Sub-Registrar ald that of Registrar are based on different Iists and the letter dated 07.O4-2O25 cannot have a retrospective effect.

37. Placing reliance on the Hon'ble Apex Court judgment in Commissioner of Police, Bonbag a. @rdha;ndrrs Bhanjit, it is contended that orders once made, the purport of the order and content cannot be improvised and has to be read and understood on the contents of the order itself. It is further contended that any improvemeut made by way of counter affidavit or submissions caanot be added to chalge the purport ofthe order.

It is submitted that as the subject ma1 I rr i.e., plots in various subdivided survey number(s) of Sy.No.36 are parcels of land in this batch of writ petitions which pertain to the notification, this Court may consid.: ' the order of learned Single Judge, unless different set of trcts are borne out of record.

JAK,J W.P.No.4475 of 2021 & barch properties in Serilingampally Mandal and the subject property of the writ petitioner was reflected as Govemment land(s) in tlle Khasra Pahani, hence prohibited from being registered. It is further submitted that District Registrar on appeal confirmed the order of the Sub-Registrar on the basis of notifrcation dated 26.09.2013 issued by the oflice of District Collector, Ranga Reddy District. That the properties in Sy.No.36/AA one in the prohibited list.

42. It is submitted that District Registrar has not erred in rejecting the documents and as such refusal to receive and register the documents presented by the petitioners in the writ petitions are in accordance with law.

43. Learned counsel relied on the judgment of the Hon'lrle Apex Court in Mohinder Singh eill and another a. fhe Chief Election Commissioner, Neut Delhi and others2, invited the attention of this Court to Paragraph No.8 of the judgment, wherein the observations of Honble Justice Bose in Commissioner o! Police, Bombag o. hrdhanda.s Bhanji (1 supra) were extracted, on the basis 2 lreza; r scc +os : ;--*F.i-:=-!i6*nJi.sr :_!r. : 26 JAK,J W.P..\l ,.4475 of 2021 & batch of the contents, it was contended that nol tication of the office of Collector have to be construed or L the basis of language used therein.

44. It is submitted that pursuant to Sectir 'n 22-A of the Registration Act, 1908 (for short 'the Acf_l va.ious notifrcations were issued across the State tr. the offices of District Collectors. That one such notihcatior issued by the office of District Collector, Ranga Reddy D s trict, is dated

26.O9.2OL3.It is further submitted that on _. re information and data collected/gathered at the ground le ,zel, properties in various survey numbers have been irr, 'luded in the notihcation and the notification came to :e issued on

26.09.2013. It is also submitted thar Collector is empowered to issue notification under Sect r n 22-A of t}j.e Act.

45. It is submitted that upon the exerr) se of powers under Section 22-A of the Act, lands are in<:l _rded or listed under any of the Sub-Sections of Section 22 ,,,(ll(a e) of the Act. It is further submitted that lands in ul .ich the State Government has "avowed" or "accrued" intere st can also be 27 JAIqJ W.P.No.4475 of 2021 & batch included/listed in the notilication under Section 22-A of the Act, that the notifications are issued to protect the properties from-being claimed as private properties, etc,. It is submitted that the order of the learned Single Judge in W.P.No.19O69 of 2074 is pertains to set of lands situated in Hafeezpet and the order may not be extended to other areas, as the order is very specific to particular parcels of land. It is further contended that on OZ.O4.2O2S, the said parcels of land in various subdivided survey numbers of Sy.No.36 in Gopalpally Village have been notified. It is also contended that the respondents be given liberty to proceed in accordance with law as the said plots in survey numbers have been included in the notihcation dated OZ.O4.2O2S of the oflice of District Collector, Ranga Reddy District.

46. Heard learned counsels, pemsed the record, considered the submissions.

47. In all these writ petitions, petitioners are purchasers of various plots in tJ.e main Survey No.36 of Gopanpally Village, Serilingampally Mandal, Ranga Reddy District. It is the specific case of all the petitioners that they presented ZE . JAK,J W.P. \ ).4475 of 2021&batch sale deeds, development agreements, gi t deeds and agreement of sales before the Sub-Registrar, Serilingampally on various dates for registre.l ion. That Sub- Registrar without assigning any reil ions refused registration. It is observed from the rec < rd that Sub- Registrar placed reliance on a communicat:r n of the office of Tahsildar (Deputy Collector Cadre), S erilingampally Mandal, dated Ni1.09.2011, Lr.No.B/32i l2Ot7 (page No.23, P3) and refused registration.

48. On appeal District Registrar confirmo, I the order of the Sub-Registrar on the basis of noti: ication dated

It was contended that the Sub-Regi: trar and the District Registrar on appeal could not have refused registration of documents. It was further ,: rntended that the notification dated 26.09.2013 was rnly a draft notifrcation and the same cannot be relied t y the ofhce of District Registrar. 29 JAIiJ W.P.No.4475 of 2021 & batch

50. It is pertinent to extract the relevalt portion of the notification communicated to the offrce of Sub-Registrar. On a perusal of the notification dated 26.09.2013 communicated which contains the list of prohibited properties, can at best be a notilication calling for objections to arrive at a final list of prohibited properties. The notification cannot be termed as a final notification of prohibited properties upon which documents car be refused for registration. The notification relied on by the 30 JAK,J W.P I r.4475 of 2021 & batch District Registrar calnot be said to be in ttL: re with the law laid down by the Full Bench.

52. 2. l*arned senior counsel for the petitioners submits that t]le said . notification is witJrout power or jurisdiction- A.no+ification carr be issued concerning the properties which. are mentioned in Section 22(tl(ll{el ot the Act by the State Government arrd the Diskict Collector has no power to notiff any properties covered by Section 22@lltl(el of the Act as t}le registration of Government lands by way of deeds of conveyalce were prohibited. Learned senior counsel placed reliance on earlier orders issued by the Government in memo No.289O8/JAl /2OO4-1, dated 05.11.20O4 and memo No.59734/JA.I /2OO5, dated 18.05.2009, which inter alia disclosed tlrat these lands are treated as private lands and directions were issued for mutation in terms of the orders in C.S.No.14 of 1958.

3. trarned senior counsel further submits t]lat attempts made by the State Govemment in this Court and the Honble Supreme Court have failed and tJrerefore, ttre above orders are issued. kamed senior counse_l therefore submits that tJ'"e present notification issued by the District Collector treating it as sarkari is contrary to the orders of the Govemment and the District Collector does not have competence and power to overrule the orders of the Governrnent and noti-ry the subject land as sarkari land.

4. The matter rmderwent few adjournments at the instance of the learned Advocate General. When the matter is called, the Advocate General produced a memo Frled by the 2nd respondent, wherein reference was made to the order of status quo passed by the Supreme Court in SI,A, (C) No(s).17362-17363/2ot4 arrd also orders passed.by the Joint Collector, Ranga Reddy Disrrict in case No.DS/5412/2014, dated o6.oa.2ot4, suspending the mutation granted in respect of M / s. Savera constnrctiotl.

6. Learned Advocate General submits that th : lands in Survey Nos.77, 7a, 79 and 80 of Hafeezpet rillage are Government lands and that the Governmeril is taking appropriate steps in this regard.

7. As regards the rival contentions on val-( us issues concerning status of land and Governmelr right to assert its title that cannot be gone into in this :ase.

8. The only issue for consideration in this wri I pctition is whether the notification issued by the Distci:. Collector amounts to prohibition of registration of lands mentioned therein concernir:g Surv-ey Nos.Z ? to 80 of Hafeezpet Village in pr'-:ported exercise of ptr rer under Section 22(A)(ll(e) oi the Act. 9. 10. In other words, learned Advocate Gerrr ral fairly submits that there is no notification issued as on today under Section 22(Ll(21 of the Act. It is further , ubmitted that only after receipt of report from tlrr District Collector and after examining the same by the State Government, appropriate action as warTante 1 by law more particularly under Section 22(A)(2) (, t}le Act would be taken. 1 I . In view of the submission of learneci Advocate Genera], it is made clear that notificati,,n dated 26.09.2013 is not a notifrcation under Sectio t 22(trl(21 of the Act and since, as on today, there is no such notifrcation issued under Section 22(A)(2) c I tJ'e Act, there is no restraint on t.Ile registering arr hori$r to receive and process the deeds of conveyance r:, ,nceming the lands in Survey Nos.79 to 8O of Hafeezpet \ illage.

Hence, the Writ Petition is disposed of dir cting the Sub-Registrar to receive ald process the deeds of 33 JAK,J W.P.No.4475 of 2021 &barh conveyan@ without reference to the District Gazette notification dated 26.O9.2013 in accordarrce with the Indian Registration Act, 19O8 and the lrdian Stamp Act, 1E99. However, it is open to the registering authority to refuse to register tfre deeds presented b€fore him, if he has arly other objection, by duly assigning reasons in support of such decision and communicate the decision to the petitioners. It is made clear that mere registration of deed of conveyance does not confer title to the prop€rty and it is made clear that this order does not preclude the Government to take appropriate steps as v/arranted by Iaw and to assert its tiue. No costs."

54. This Court has taken note of the order of the learned Single Judge and the submissions made by learned Advocate General in the matter in W.P.No. 19069 of 2074.

55. The notification that fell for consideration in W.P.No.19O69 of 2074 arld the notiflcation in these writ petitions is pari materia, it is appa.rent that the notilications issued are on the same day by the oflice of the District Collector. Having perused the order of the learned Single Judge, this Court is of the view that the contention, that, order in W.P.No. 19O69 of 2014, is applicable to the facts of the case is tenable and valid.

56. 57. This Court is not inclined to take a different view from what has been held in the order of . earned Single Judge at Paragraph No.12, the same view i; endorsed by this Court.

A combined reading of the law laid down by the Full Bench of this Court and the Division bench ald various orders in writ petitions, it is evident that any refusal for registering a property by an oflice of Sub- Registrar can be only in accordalrce with the Act ald as per the law laid down by the Full Bench. The notilication issued in not in accordance with law.

59. ln Vinjamuri Rajogopala Clury and otlr.rlrs a. Principal Secretary, Reoenue DepanA.menl Hgderabad and others (3 supra), the Full Bench summarised the conclusions at Paragraph No.158 (in the form of points from I to XV), the relevant points in the present context are as follows: "158. We, thus, summarize our conclusions and issue directions as follows : - (i) The authorities mentioned in the guidelines, which are obliged to prepare lists of properties covered by clauses (a) to (d), to be sent to t}le registering authorities under the provisions of Registration Act, o 2023 SCC Online TS 4565 36 . JAK,J W.P.l.L4475 of 2021 & batch shall clearly indicate the relevant clause urr, each propert5r is classi-Eed. (ii) Insofar as clause (a) is concr:: concerned District Collectors shall a-lso i-r < statute under which a transaction and its regi prohibited. It is submitted by learned counsel for official respondents that by letter dated O7.O4.2O25; ollice of District Collector communicated a list of prohibited properties to the office of Sub-Registrar(s) (through the office of IG) and authorities be granted liberty to initiate steps or act in the light of the new tist dated O7.O4.2O25. Needless to state that authorities are empowered under law ald are not precluded to act within the frame work of law. 6 1. It is submitted that pursuant to interim directions documents presented were received, registered ald released in the batch of writ petitions. In view of the submissions made, this Court is of the opinion that no further orders are necessary as far as registration of documents is concerned " qua" the petitioners in the batch of writ petitions.

Having considered the entire factual matrix of the case, the order of the learned Single Judge, ttre law laid down by the FuII Bench, the Division Bench of this Court and the Act, this Court is of the opinion that the order of respondent No.2 bearing No. 18183/GLl2OL9 dated 38 JAK,J W.P I c.4475 of 2021 & batch 17 /06/2020 acting on the alleged noi, fication dated 26.09.2013 No. t5/4733/2O13 File Serilingampally/Gopanpally, said to have t een issued by the District Collector, confirming the Ord:- of the Third Respondent in Retusal No.76 of 2019 date< tg/lI/2)lg, acting on the alleged letter bearing No.B/3t2 Z/2OO7, d.ated O8/O9/2OIl, are set aside.

63. Be that as it may, Authorities are not 5 recluded from taking steps as warranted by law, in .-, rspect of the prohibited properties communicate d, uid.e letter dated 07.O4.2O25, by oflice of District Collector to he office(s) of Sub-Registrar(s) (through the office of IG).
