BHASKAR REDDY WRIT PE-TITION No.282O of 2o25 This writ petition is filed praying this Court to declare the action of the respondent authorities in not conducting survey and not processing the application dated 16.1O.2024 submitted by the petitioner followed by online application dated 12.12.2024 lor conducting survey in Sy.No. 126, situated at Madeenaguda Revenue Village ald not marking the plot bearing No.225 in Sy.No. 126, as illegal, arbitrary and for other appropriate reliefs.
2. It is stated that the petitioner is the absolute owner and possessor of the plot bearing No.225, in Sy.No.126, situated at Madeenaguda Revenue Village, having purchased the same through registered sale deeds bearing document Nos.7987 and 9277 of2OO7.
3. A careful examination of the sale deeds bearing document Nos.7987 and 9277 of 2OO7 would reveal that the petitioner has purchased open plots located in Sy.No. 126. It is not the case of the petitioner that the subject property is agricultural land and that they paid stamp duty or registration fees on acre basis. In the instant case, the petitioner,s land is clearly identified as open plot but not agricultural land. Since the petitioners' property is not agricultural land, the Survey Department has no jurisdiction to conduct F_Line Survey as per the Circulars issued by the Commissioner, Survey, Settlements, and l"and Records. For the aforesaid reasons, this Writ petition is devoid of merits and is liable to be dismissed.
4. Accordingly, this Writ petition is dismissed. However, .the petitioner is at liberty to take the services of licensed surveyor for conducting the survey of his property i.e., open plot, if he is so advised- As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
