The writ petition is filed seeking a Mandamus, declaring the action of the respondents in not taking any action on the persons, who have committed theft, attempted to murder, illegally trespass into the petitioner’s lands and wrongful restrained of the petitioner, based on the written complaints dated 3-4-2005 and 4-8-2005, as illegal and arbitrary. For certain offences under Indian Penal Code, the complainant gave a report to the 3rd respondent for taking appropriate action. Heard the learned counsel for the petitioner and the learned Government Pleader for Home appearing for the respondents. Appropriate decision has to be taken in accordance with law whether a case has been registered or not under Section 154 Cr.P.C. Therefore, without entering into the merits of the case, the writ petition is disposed of directing the 3rd respondent appropriate decision in registering the case on written complaints dated 3-4-2005 & 4-8-2005 if the allegations in those complaints make out a cognizable offence.
