BHASKAR REDDY WRIT PETITION No.2522 OF 2025 ORDER: This writ petition is filed seeking following relief: "... to issue a writ in the nature of a writ of mandamus or any other appropriate writ direction order or orders decla:-ing the action of the respondents herein, particularly respondent Nos.3 to 6, despite registered a case in Crime No. 77 12024, dated:O7.O2.2O24, and, till today, respondent Nos.3 to 6 herein neither arrested accused Nos.l and 2 in the crime. nor respondents herein added Sections 3O7,l2O- B, 322, 325 and 503 of IPC, apart from Sections 447, 427 and 324 rlw 34 of IPC in FIR No.77l2O24, dated: 07.O2.2O24 against accused Nos.l and 2 as illegal ald also violation of Articles i4, 19, & 21 of the Constitution of India, and consequently direct respondent Nos.3 to 6 to arrest the accused Nos.l and 2 in Crime No.77 /2024 and conduct further investigation under Section 173(8) of Cr.P.C., by filing lhe supplementary charge-sheet with the ollences punishable under Sections 3O7, l2O-8,322,325 and 503 of IPC in Crime No. 77 /2024, dated. 2. The case of the petitioner is ttrat he lodged a complaint against accused Nos. 1 and 2/respondent Nos.7 and 8 alleging that they have made an attempt on his life. Basing on the said complaint, police have registered a case in Crime No.77 of 2024, dated 07 .O2.2024 on the file of the Pahadishareef Police Station, for the offences under Sections 447, 427 arrd 324 read with Section 34 of the Indian Penal Code, 1860 (IPC). Even though -the allegations levelled against the accused are cognizable offences, jlCpetitioner has sustained grievous injuries and the 2 accused attempted on his life, the police without registering the crime for the offence under Section 3O7 of IPC, simply registered a case only for the offences under Sections 442,422 ar-d 324 read with Section 34 of IPC by colluding with the accused. However, as a counter blast, when the accused also lodged a complaint against the petitioner and others, police have registered a case in Crime No.76 of 2024 for the offences under Sections 3O7, 147 and 148 read with Section 149 of IpC.

It is the further case of the petitioner that during medical examination, it rvas disclosed that the petitioner has sustained grievous injuries all over his body arld to that effect medical report was issued. Therefore, the accused are liable for prosecution for the offence under Section 307 of IpC. Instead of filing the charge sheet for the said offence, police have filed charge sheet for the offences under Sections 447, 422 arrd,324 read with Section 34 of IPC. Therefore, the petitioner was constrained to submit a representation dated 31.12.2024 duly enclosing all the relevant documents to respondent Nos.3 to 6 requesting them to conduct further investigation and frle supplementary charge sheet and also to arrest the accused in Crime No.77 of 2024. 1 4 6 The grievance of the petitioner is that respondent Nos.3 to did not act upon the representation dated 31.12.2024 submitted by the petitioner. Learned Assistant Government pleader for Home, on instructions, would submit that acting upon the complaint submitted by the petitioner, after conducting preliminary authorities have righfly registered the case against the accused in Crime No.77 of 2024 for the offences under Section s 447 , 422 a\d, 324 read with Section 34 of IpC. It is further stated that as the investigation also does not revear that the commission of offence under Section 3OZ oflpC, the police authorities have filed charge sheet/final report for the aforesaid offences. It is further stated that the accused have cooperated with the investigation and they are very much present in the very same locality, and therefore, police have not take any steps to arrest accused Nos.1 and 2.

In the light of the same, this Court withott expressing any opinion on the allegations made in the,representation O1.12.2024, deems it appropriate to dispose of the Writ petition t I I 4 directing respondent Nos.3 to 6 to examine the representation dated 31.12.2024 submitted by the petitioner duly taking into consideration of the material and pass appropriate orders, in accordalce with lau'.
