JUSTICE JUWADISRIDEVI CRIMINAL PETITIO N No.1193 of 2025 ORDER: This Criminal Petition is filed by the petitioner-accused No 1 seeking to quash the proceedings against him in Crime No.379 o'f 2019 of the Station House Officer, Jangaon Police Station, Warangal District, registered for the alleged offences under Sections 498-4 of the lndian Penal Code and 3 and 4 of the Dowry Prohibition Act. 02 Heard Sri Y.Shashidhar Reddy, learned counsel for the petitioner and sri Jithender Rao Veeramalla, learned Additional Public Prosecutor for the State.
Though this petition is filed for quashing the proceedings in the crime, during the course of arguments, learned counsel for the petitioner has sought for directions to the Police to proceed with I { investigation by issuing notice under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita (for short 'BNSS') (Previously Section 41-A of the Code of Criminal Procedure).

ln view of the above, without going into merits of the matter, this criminal Petition is disposed of directing the Police concerned to proceed with the investigation in the above crime after issuing notice under Section 35(3) of the BNSS (Previously Section 41-A of Cr.P C ) to the \ I 2 petitioner-accused No.1 and the Investigating officer sha, arso forow the guidelines formulated by the Honourable Supreme C;ourt in Arnesh Kumar v. State of Bihar and anotherl scrupulously. However, the petitioner-accused No.1 sha, submit his defense and co-operate with the lnvestigating officer as and when required by furnishing information and produce arr rerevant documents/materiar required for the purpose of the investigation and the Investigating officer sha, consider the same before filing appropriate report before the learned lVlagistrate concerned.
