31.12.2019, to the 3rd respondent-u'hereby he refused to issue the e-pattadar passbook and title deeds in respect of the petitioner's land to the extent of Acs.20.05 gr-rntas in Sy.No. 105, Acs.2.l3 guntas in Sy.No.lO2 lA, and Acs.2.07 1n Sy.No. 103/G, situated at Koyaguda-Yellapur guntas Village, Etrrrnagaram Mandal, Mulugu District-in spite of existing pattadar passbooks and title deeds in favour of the petitioner arrd having held that the petitioner 15 ln possession of the said land, AS illegal, arbitrary, and contrary to the provisions of the ROR Act; and consequently, to direct respondents 3 and 4 to forthwith issue the e- pattadar passbook and title deeds based on the existing revenue records which stand in the name of the petitioner Page 2 of6

When the matter is taken up for consi leration, tl e learned counsel for the petitioner submit ed that the petitioner is the pattadar and posses: or of land aclmeasuring Ac.20.05 guntas ln Sy.No O5, Ac.2.13 guntas 1n Sy.No. lO2lA, and Ac.2.O7 guntas 1n Sy.No.103/G, totaling Ac.24.25 guntas. situated at Koyaguda Yellapur Village, Eturnagarz m Mandal, Muiugu District (hereinafter referred to ar; the "subject property"). The petitioner's narne has been e atered in the revenue records for a long time vidr Proceedings No.B/81 /20 12, dated 31.05.2014.

Despite the fact that the petitioner is i I continuous possession and enjoyment of the subject I rnd ancl has been cultivating it, in response to the - :presentation made by the petitioner dated O5.O7 .2( 19. the 4th responcient, vide proceedings in Rc.No.8, 69812OI9-2, dated 31.12.2019, addressed a letter to the 3'd respondent/Revenue Divisional Offic: -, Mulugu. However, the 4th respondent issued ar e-passbook ;\ Page -1 o[ 6 reflecting entries only in respect of Sy.No. lO2lA to an extent of Acs.2.13 guntas and Sy.No.103/G to al extent of Acs.2.O7 guntas, while inadvertently omitting Sy.No. 105 to an extent of Acs.20.05 guntas on the ground that the petitioner had not been cultivating the said land for the past 20 years. The 4m respondent further stated that 21 ryots of the same village have been cultivating the said Iand during this period and requested further instmctions in the matter.

The learned counsel for the petitioner further submitted that, without conducting any enquiry and without obtaining any report from the Revenue Inspector or Village Revenue Officer, the 4th respondent simply washed his hands of the matter by merely addressing a letter to the 3rd respondent. He also submitted that neither the 4th respondent nor the 3'd respondent has taken any further action on the grievance raised by the petitioner. Page 4 of6 .-fFlt

On the other hand, the learner Assistant Government Pleader, representing tf e leamed Government Pleader for Revenue, upon . astructions, submitted that the 3.d respondent will cons,i ler the case of the petitioner and pass appropriat: orders in accordance with the provisions of the Bhu E harathi Act,

Having heard the learned counsel for t re petitioner and the learned Assistant Government Pleader for Revenue, and after considering the mat :rial placed before this Court, this Court deems it a1 propriate to direct the 3.d respondent to conduct a prope r enquiry on the reference made by the 4t)'t resp,r ndent vide proceedings in Rc.No.8/698 l2Ol9-2, daterl 31.12.2019, with regard to the petitioner's case, r rd to pass appropriate orders strictly in accordance r.ith law, AS expeditiously as possible, preferably withir a period of srx months lrom the date of receipt of a copy of this order. r Pagc 5 of6
