2. Sri Mohammed Ziauddin Asif is claiming that he is the President ol the petitioner Societ5r on the strength of an order in O.S.No.515 of 2023 and as such he is representing the petitioner society. Mohammed Shareefuddin and Md. Shadut, claiming to be the Members of the petitioner Society, filed a suit in O'S.No.515 of 2023 against Mr' Mohd' Z:ubair Hussain and others seeking perpetual injunction' Vide order dated 04.04.2024, the learned I Additional Junior Civil Judge, Siddipet, granted injunction in I'A'No'852 of 2023 rn O.S.No.515 of 2023. The said order is a contest order. t {ccording to the learned counsel for the petitioner, no 3. appeal is preferred against the order dated O4'O4'2024 and it 2 attained fin,ality. The petitioner also filed anothr:r suit in O.S.No.395 ,tf 2024 for recovery of rents and vide order dated 13.O8.2024 the learned principal Junior Civil Judge, Siddipet, gr:amted ad-interim injunction order. The said suit is pending and the said injunction is subsisting. The petitioner filed W.P.No .25187 of 2024 seeking a direction to the police to handover the community hall (Madina Function Hall) and Funeral Vehicle bearing No. .lS 36 T 16Z6 registered on the name of the Commissioner, Siddipet Municipalit5r. The said vehicle is in the custodr/ oi ,t " President of r.he petitioner Society. The said writ pr:tition is pending ald no interim orders are passed therein. During the pendency of the writ petition, the petitioner has submitted a representation dated OT.12.2O2.l to respondent No.2 with a request to handover the Government Muslim Communitv Hall (Madina F.unction Hall) situated at Siddipet to the petitioner. Despite receiving and acknowledging the same, responctent No.2 did not act upon the same. Aggrieved by the said .action of respondent No.2, the present writ petition has been filed. I I t 3

Learned Standing Counsel appearing for respondent No.2 has produced written instructions of respondent No 2' wherein it is stated that respondent No'2 has already handed over the Funeral Vehicle bearing No'TS 36 T 1676 to the President of the petitioner society on 14' 1l '2024 and that respondent No.2 will consider the representation dated 07.12.2024 of the petitioner and take action strictly in accordance with the procedure laid down under the Telangara Municipalities Act, 2019' The said written instructions are piaced on record'
5. Though Mohammed Ziauddin Asif is claiming to be the President of the petitioner Society pursuant to order in O.S.No.515 of 2023, he is not a party to the said suit' However, it is for respondent No'2 to consider the said aspect and take action while considering the representation dated
07.12.2024 submitted by the petitioner' In the light of the said cliscussion, this writ petition is 6 disposed of directing respondent No'2 to consider the representation dated 07.1,2'2024 submitted by the petitioner and to take action strictly in accordance with the procedure If laid down under the Telangana Municipalities Act' 2019' 4 respondent No.2 is not inclined to accept the reqr_rest made by the petitioner, he shall assign reasons, pass orders and communicate a copy of the said order to tLre petitroner. He shall complete the said exercise within a period of four weeks from the date of receipt of a copy of this order. Miscelianeous petitions, if any, shall stanr_l closed.
