The peritioner, by mortgaging tl*: subject property obtained housing roan frorrr Canara Ba,k and executed Memorandum of Deposit of Title deecl arrd approached the respondent N o.3 for registration. However, the respondert No.3 orally refused to rellister the same on the ground that the sub,ect property is included in tirc prohibitory property list. Aggrieved b1, such rejection, petitioner filed this writ petition.

It is per-tinent to note that in terms of the saitl Circular, all the Sub- Registrar.s shall invariably examine the documents and thev sl.Lall, as expeditiousl' as possible preferabry within a period of one wcek, either register the dor:ument or pass refusal order, in terms of the Registration Act, 1908 and Inclian Stamp Act, 1g99 ancl communicate the same to thc concerned parlies; in no case, the Sub_Registrars shall not refuse the documents oralry for registration and it must be fo,owed ,y a rvritten refusal order $. In view of the above an<l without expressing any opinion on merits of the casc, thjs writ petition is disposed of directing the Registering 5 Authority to follon, the Circular Mcmo No.G3/ 9722/2024, dated L208'2024 ancl consider registrability of the subject document and pass orders, as expeditiously as possible, preferably within a period of one (01) week from the date of receipt of the subiect document, by duly assigning reasons in support of such decision and communicate the said decision to the petitioner.
