The petitioners claim to have presented documents for alienation of respective plots before the Sub-Registrar, Gopalapatnam, Visakhapatnam District, respondent herein. Their grievance is that the respondent is not receiving the documents nor processing the same.
Operative part
Learned counsel for the petitioners submits that the respondent cannot refuse to discharge his functions under the A.P. Registration Act (for short ‘the Act’), that too without furnishing any reasons. Learned Government Pleader for Revenue, on the other hand, submits that the transactions are in relation to the land held by Sri Varaha Lakshmi Narasimha Swamy Temple, Simhachalam and there are clear directions by this Court and various authorities not to effect registration in respect of such lands. The Act prescribes the procedure to be followed for processing the documents, that are presented registration. In the recent past, Section 22-A was added prohibiting registration of documents in respect of various categories of lands, including those held by endowment institutions. In case, the document presented before the registering authority relates to such prohibited categories of lands, he can simply mention the same and return the document. The aggrieved party would be in a position to work out his remedies in the event of such reply being given. There cannot be any justification in refusing to receive the documents. Such a course would amount to abdication of duties of the authorities under the Act. Therefore, the writ petitions are disposed of directing that the respondent shall receive the documents that may be presented by the petitioners and pass appropriate orders thereon. It is made clear that in case, the documents pertain to any prohibited categories of lands or if the registration cannot be effected for any other reasons, he shall communicate the same in writing respective petitioners within two (2) weeks from the date of presentation of the documents.
