This Court, uide order, dated 29.10.2O19, u,hile disposing of the said writ petition, directed the Tahsildar to consider the representation dated 28.O7 .2OlB submitted by the petitioner therein and issue 'e' pattadar passbook if the petitioner is otherwise entitled and subject property is not included in the prohibitory list maintained by the Government and the Tahsildar is further directed to take decision and communicate the same to the petitioner within a period of four weeks from the date of receipt of a copy of the order.

Learned counsel appearing for the petitioners has vellemently contended that acting on the representation of \- the petitioner therein, the Tahsildar has passed rejection 1 I I I 2 orders lor issuance of pattadar passbooks/title deeds in favour of the petitioner therein, but the same has not been communicated to the petitioner within the stipulated time, therefore, there is willful and deliberate violation on the part of the respondent-authorities to initiate proceedings under the provisions of the Contempt of Courts Act, l9Z l.

Soon after receipt of the notices in the contempt case, respondent No.2 herein filed a detailed counter-affidavit, annexing a copy of the memo No.D /967 /2OlZ dated 23.03.2020, rvherein it is stated that as per the Ranga Reddy District Gazette Extraordinary No.RR.No.8S dated 26.O9.2O13 at Serial No.47, the land in Sy.No.65/ 17 admeasuring Ac.25.00 guntas situated at Khanapur Village, Gandipet Mandal, is notified as prohibitory property under Section 22-A (1) (a) of the Registration Act,

1908. It is further stated that unless the said properer is deleted from the prohibitory properties list, the respondent- authorities cannot issue pattadar passbooks in favour of the petitioner :'7

Learned counsel for the respondents submitted that the pending consideration of the representation submitted by the petitioner in W.P.No.74737 of 2079, the Government has repealed the Telangana Rights in Land and Pattadar Pass Books Act, 197 7 (for short the Act, 197 1') and enacted new Act called as "the Telangana Rights in Land and Pattadar Pass Books Act, 2O2O" (for short Act, 2020') I and as per the Act, 2O2O, the petitioner has to submit an online application for issuance of pattadar passbooks through appropriate module in Dharani Portal. \ \ I

In view of the above submissions, this Court is of the view that there is no willful or deliberate violation on the part of the respondents to initiate proceedings under the provisions of the Contempt of Courts Act, 1971. However, the petitioners herein are permitted to submit an online application through appropriate module in Dharani Portal for issuance of pattadar passbooks in their favour in respect of the subject property. If the petitioners submit online appiication fullilling all the necessary requirements, the respondent-authorities shall examine the same and 4 pass suitable orders in accordance with law, as expeditiously as possible, preferably, within a period of three (03) months from the date of receipt of a copy of this order and communicate the same to the petitioners. 7 .
