Petition under Article 226 ot lhe constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the Respondent Nos.2 to 5 in non-considering the on-line application of the Petitioner through vide No. 2400015632, dated 10.03.2024 and non-initiating to delete the land of the Petitioner to an extent ot Acj.21 Gts in Survey No.605/3, which is situated at Pedda Amberpet Revenue Village, Abdullahpurmet Mandal, (Erstwhile Hayathnagar Mandal) Ranga Reddy District from the Prohibited Properties and non-initiating to transfer the land of the Petitioner from Notional Khata to Patta Land is illegal, arbitrary, unconstitutional and violation of Articles 14, 15,21 and 300-4 of Constitution of lndia and also violation of Principles of Natural Justice and consequently direct the Respondent Nos.2 to 5 to consider the on-line application of the Petitioner through vide No. 24OOO15632, dated 10.03.2024 and delete the land of the Petitioner to an extent of AcJ.21 Gts in Survey No.605/3, which is situated at Pedda Amberpet Revenue Village, Abdullahpurmet Mandal, (Erstwhile Hayathnagar Mandal) Ranga Reddy District which is kept under the Prohibited Properties and transfer land of the Petitioner from Notional Khata to Patta Land lA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in supiport of the petition, the High Court may be pleased to direct the Respondent Nos.2 to 5 to consider the On-line application of the Petitionerthrough vide No. 2400015632, dated 10.03.2024 and delete the land of the Petitioner to an extent of Ac.'l .21 Gts in Survey No.605/3, which is situated at Pedda Amberpet Revenue Village, Abdullahpurmet Mandal, (Erstwhile Hayathnagar Mandal) Ranga Reddy District which is kept under the prohibited Properties and transfer land of the Petitioner from Notional Khata to patta Land pending disposal of the Writ Petition Counsel for the Petitioner: SRl. It is stated that the petitioner is the owner and possessor of the land to an extent of Ac. 1.21 guntas in Sy.No.6O5/3 of Pedda Amberpet Revenue Village, Abdullapurmet Mandal, Ranga Reddy District and her name was also recorded as pattadar in the revenue records and the revenue authorities also issued pattadar passbook No.TOSO1022 lO72 uide Kh.ata No.6O416 under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act,2O2O (for short "the Att, 2O2O"l. lt is further stated that the respondent authorities without taking into consideration of the fact that the petitioner is pattadar, have notified the subject property as prohibited property uide Gazette Notification No.ESl4gT6l2Ol3lHayathnagar/Pedda Amberpet, dated 26.09.2013 and in the pattadar passbook the same was shown as Laoni Patta issued under the provisions of the Laoni Rules framed under Telangana Land Revenue Act, 1317 Fasli and therefore, the petitioner had submitted an application No.24O0O I5632, dated lO-O3-2024 seeking for deletion of the land liom the list of prohibited properties and also change the nature from Notional Khata to Patta Land. Considered the submissions of the learned counsel for the respective parties and with their consent, this writ petition is disposed of at t he admission stage. 3 Revenue Ms.T.Swetcha, learned Assistant Government pleader for vehemen tly appearing for the respondents has contended that ln the pattadar passbook upon by the petitioner, it is recorded as Laoni patta and as such the petitioner was assigned the subject land and she is not entitled to transfer or alienate the subject property in favour of third lclicd parties. 4 As seen from the above, the grievance of the petit.ioner is Khata to that for changing the nature of land from Notional Patta, it is not the case of the petitioner that she is efforts to al.ienate the property in favour of th ird parries violation of the conclitions ol_the assignment law that if the It is u,ell settled petitioner has violated the assignment patta conditions, the respondent authorities have power to take appropriate action against the petitioner. Since the petitioner is only seeking for conversion of Khata from Notional to patta, this making 1n I 3 CVBR, J wp_2058 2025 Court deems it appropriate to dispose of this writ petition, directing the respondents to examine the petitioner's application No.240O015632, dated 1O.O3.2024 and pass appropriate orders in accordance with law and if the petitioner is not otherwise entitled for the same, the respondent authorities shall pass a reasoned order and communicate the decision thereon to the petitionef . . The entire exercise shall be completed within a period of eight (08) weeks from thc date of receipt of a copy of this order., .
5. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
