This revision is directed against the order dated 19.02.2004 in Crl.M.P.No.103 of 2004 in Crime No.359 of 2002 on the file of the

Additional Judicial Magistrate of First Class, Hyderabad, West & South. The petitioners herein gave a report, on the basis of which a case in Crime No.359 of 2002 was registered by Balnagar Police against the respondents for the offences punishable under Sections 120-B, 403, 406, 420, 423, 467, 477/A and 511 IPC. After completion of the investigation, it appears that the police submitted a final report under Section 173 Cr.P.C., referring it as false and stating that the entire transaction is civil in nature. A protest petition was also filed and the same was numbered as Crl.M.P.No.103 of 2004. The learned Magistrate after recording sworn statements and also considering the complaint and the other documents came to the conclusion that the police report is correct and the entire transaction between the parties is civil in nature, and accordingly dismissed the complaint. The same is questioned in this revision. Heard both sides. From a perusal of the material placed on record, this Court is also of the view that the entire transaction between the parties is civil in nature and the Court below is justified in dismissing the protest petition under Section 203 of Cr.P.C., and hence, no interference is called for. Accordingly, the Criminal Revision Case is dismissed.
