Petition under Article 226 of the Constitution of lndia, praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more. particularly one in the nature of writ of [\/andamus to declare the action of the Respondent No. 'l in intending to settle the civil dispute in respect of the land admeasuring '1375 Sq. Yards situated in Sy. No. 25511, 25512, 2531P, 256 and 257 of Daya Garden, Chetkur Village, [Voinabad Mandal, Ranga Reddy District in the police statlon without following due process of law as arbitrary, illegal and vrolation of Article 14 and 21 of the constitution of lndia and consequently direct the Respondent No. 1 not to insist the Petitioner to settle the dispute with the Respondent No. 4 in the Police Station in respect of the land admeasuring '1375 Sq. Yards situated in Sy. No. 25511 ,25512,2531P,256 and 257 of Daya Garden, Chelkur Village, Moinabad lVlandal, Ranga Reddy District without following due process of law in the interest of justice. VINOD KUMAR Writ Petition No. 1556 of 2024 ORDER: Heard learned counsel for the petitioner, learned Government Pleader for Home appearing for respondent Nos.1 to 3, and with the consent of fhe learned counsel appearing for the parties, the writ petition is taken up for hearing and disposal at the admission stage.
2. Despite service of notice on respondent No.4, there is no appearance on her behalf either in person or through learned counsel. However, having regard to the manner of disposar of the writ petition and nature of lis involved, this Court is of the view that the matter can be proceeded with, without having the audience of the said respondent.
3. The case of the petitioner, in brief, is that,.the lst respondent is pressurizing the petitioner to settle the civil dispute in respect oF land purchased by the petitioner under registered sale deed bering document No.B525 of 2023 as rectified vide rectification deed dt.Lt.O7.2O24, situated at Dayal Garden, Chilkoor Village, Moinabad Mandal, Ranga Reddy District, without following due process of law, which action of the respondents-authorities it is contended as illegal, arbitrary and in violation of Articles t4 and Zt of the Constitution of India. lIE\ r-.1

Per contra, learned Government pleader for H,tme appearing on behalf of n:spondent Nos.1 to 3, while denying the writ averments, would submit thrrt the 4h respondent had approached ttre 1.t respondent authority and lodged a complaint on 14.0r.2024 and lased on the said complaint, :he authorities have made a GD entry and t()ok up preliminary enquiry thereinto.

Lea.red Government preader further submits thal in order to cause preliminary enquiry, the respondents-authorities have c; lled the petitioner to the policr: station and after causing preliminary enquiry, the authorities noting the :;aid dispute to be civil in nature had closed the complaint as 'civil in nature' on 20.0L2024.

Learred Government preader further submits that the respondents- authorities oxcept causing preliminary enquiry into the complaint lodged by the 4th respondent against the petitioner herein, are not interfering in the civil dispute nor pressuring the petitioner to settre ther dispute with the 4s respondent herein. 7 . The aforesaid submission made by the rearned Go'ernment preader for Home aptearing for respondent Nos.1 to 3 is taken on record. B. Havinr; regard to the submissions made as above, and taking note of the fact that on the 4th respondent approaching tle respondents_ authoritierSiid rodging a compraint on 74.07.2024, the authorities after causing preliminary enquiry thereinto having closed the same on
20.01.2074 as 'civil in nature', this Couft is of the view that the respondents-authorities are to be directed not to interfere in the civil dispute that may exist between the petitioner and the unofficial respondent herein except in accordantre with law.
9. Subject to above direction, the Writ Petition is disposed of. No order as to costs
