Heard Sri Shaik Jilani, learned counsel the appellants, appearing on behalf of Sri G.Veeraswamy, learned Government Pleader for General Administration appearing on behalf of respondent No.1, Sri Etooru Poornachander Rao, learned Government Pleader for Forest appearing on behalf of respondent No.3 and Sri Mahesh Raja, learned Government Pleader for Home appearlng on behatf of respondent Nos.5, 9 and 16 to 18' 2

3. Brief factsofthe case:

3.1. The claim of the appellants is that the land admeasuring Ac.24oo-oo gts. in Sy.No.7 situ.ted at Mansooral:ad Village, Saroornagar Mandal, Ranga Reddy District was kept under the custody of the Government as caretaker by Mrs.Haneefa Bee, W/o. Mr.Burhar_-Luddin. The said land was converterl into plots of 1OO Square yards each and allotted t.o the appellants by legal heirs of Mrs.Haneefa Bee, Mr.Md.yousuf Khan and Mrs.Vasam Tulsamnla by way of merrLorandum of gift executed in favour of the appellants. Originally, land ad.measuring Ac. 1O OOO_ OO gts. was patta land and it was taken into custody of the Government in the year 7947. The patta of Mrs.HaneefzL Bee is evidenced by Muntakhab and Sethwar No.t262/ 1352 Fasti.

It is further claim of the appellants that Mr.Md.Yousuf Khan submitted representation to the revenue authorities for conducting survey, demarcation and fixing of boundary stones in 3 respect of the subject property, but the sarre was not considered. At that stage, said Mr.Md.Yousuf Khan had filed W.P.Nos.325O9 of 2OlO and 9067 of 2O11 and the learned Single Judge of the erstwhile High Court for the State of Andhra Pradesh, disposed of the said writ petitions on O4.O2.2OII, directing the revenue ar.rthorities to conduct survey, demarcate and hx the boundary stones in respect of the land in Sy.Nos.1 to 14 and 15 to 20. Pursuant to the said order, the Deputy Inspector of Survey ald Land Records, Ranga Reddy District issued notices for condrrcting survey vide Lr.Nos.Aa / 3062 /2013, dated O2.O9.2OI3 and A4/3062/2013, dated 77 .O9.20L3 respectively and a survey was conducted on 02.O9.2O 13 and 17.O9.2013.

Thereafter, the appellants and others have frled W.P.No.26934 of 2Ol8 and batch, seeking direction to the respondents therein not to dispossess the appellants and others from the lawful possession of the property covered by Sy.No.7, admeasuring 4 1OO.OO Srq.Yards of each of the appellants situated at Mansoorabad Village, Saroornagar 1\4anda1, Ranga Rt:rldy District. The learned Single Judge disposed of the said batch of writ petitions on 3O.OB.2O1B, granting liberty to the appellants to avail the common law rernedy for establishing their title. Inspr.te of availing the said remedy, appellants have subrtitted representation to the respondent authoritier; on 2O.O3.2O23, for release of the land adrneasuring Ac.24OO-OO gts. in Sy.No.7, situzrted at Mansoorabad Village, Saroornagar Mandal, Ranga Reddy Dis;trict. When the respondent authorities failed to cc,nsider the said representation, appc,llants approache,l this Court and filed W.p.No.221 of 2024, seeking direction to respondent authoril.ies to release the. entire land, which was kept undr:r the custody o1' the Government as caretaker by the original pzLttedar. The learned Single Jr-rdgt:: has dismissed ,'A/.P.No.221 of 2024 along with the batch by way of common order dated O1.O5 2024, inter alia on the ground that the appellants were ne.,.er in 5 possession of the subject property and further held that the question of transferring the land to the appellants without possession and u.nder alleged memorandum of gift deed is baseless and further observed that in W.P.No.26934 of 2018 and batch, the learned Single Judge granted libert5r to the appellants to pursue the Civil law remedy. But the appellants without pr.rrsuing the said remedy filed W.P.No.22 1 of 2024 and batch. However, the learned Single Judge, while dismissing the writ petitions,. granted liberty to the appellants to approach the concerned authorities for allotment of 2 BHK houses and avail welfare schernes introduced by the Government. Thus, aggrieved by the said order, appellants have frled the present writ appeal.

4. Subrnissioas of learned counsel for the appellar.ts:

4.1. Learned counsel for the appellants contended that the appellants are landless poor persons and they are entitled to release of the subject land as per the gift settlement deed executed by Mrs-Haneefa 6 Bee in the year l94T and. the subject land is under the cus,tody of the Government. In such circumst:rnces, the learned Single Judge ought not to have dLsmissed W.p.No.22 I of 2024.

5. Analvsis of the case:

5.1. This Court considered the rival submissions made by l_he learned counsel for the appellarrts and perused the material available on record It is r-rndisputed fact that the appellants in earlier round of litigation approached this Court and filed W.P.No.26934 of 20lg and batch, seeking dir.ection to respon.Cents not to dispossess the appr:llants from the s;ubject property covered by Sy.No.,iz. The learned Single Judge had disposed of the said batch of writ pe.litions on 3O.Og.2O1g and the operative portion of the said order reads as follows: "In the considered_ opinion of this Court, the disputetd facts with regard to the id.entitA of t4e propertA cannot be gone into und.er Article 226 of the constitution of India. Houteuer, keel>ing it opctn for the petitioners herein to auail the common lau..t remedg for establishing their title, these w,it 7 petitions are disposed of. There shall be no order as to costs ".

The above said order clearly reveals that the learned Single Judge while disposing of W.P.No.26934 of 2Ol8 and batch, granted liberty to the appellants to avail the cornrnon law remedy for establishing their title. The said order has become final and binding upon the appellants. The appellants instead of availing the common law remedy i.e., approaching the competent Civil Court submitted representation before the revenue arrthorities on 2O.O3.2O23 for release of the land to an extent of Ac.24OO-OO gts. in Sy.No.7 situated at Mansoorabad Village, Saroornagar Mandal, Ranga Reddy District and filed W.P.No.221 of 2024 seeking direction to the respondent au.thorities to release the above said land. The learned Single Judge while dismissing the writ petition rightly observed that the donors/original owners of the appellants were never in possession of the subject land and ttre question of transferring the said land to ttre appellants without 8 possessic,n and under the alleged memorandum of gift deed is baseless. However, the learned Single Judge gr:rnted liberty to the appellants to approach the concr:rned authorities for allotment of 2 BHK houses ancl avail welfare schemes introduced by the Governme:nt.

5.3. It is pertinent to mention that the appellants have raised several disputed questions of fz:.cts in the writ petition in respect of the subject propert5r. In earlier round of litigation in W.p.No.26Lr34 of 2018 and batch, the learned Single Judge while disposing rtf the writ petitions directed the parties to avail common 1aw remedy, by its order dated 3O.O8.201t]. The appellants without availing such remedy for establishing their title, approached this Court and filed W.p.No.221 of 2024 and the learned Single Judge has rightly dismissed the saicl writ petition. 9

6. For the foregoing reasons, this Court does not hnd any ground to interfere with the impugned order passed by the learned Single Judge.
