No. 453/24 dated 13.t2.2024 is illegal, arbitrary, unjust, u nconstitutiona I and in violation of principles of natural justice and consequently, direct the respondents to restore power supply to the HT Service No'MDK2521 belongs to the petitioner immediately and to pass such other order or orders as this Hon'ble Court may deems fit and proper"' herein I 2 SN,J wP_t2lt 2025 3 Lingareddypet is running a cGM(Rev)/GM(R)/SAo(R)/AO(HT)/AAO(HT)/rAo/HT crushing unit in the Village, Manoharabad The case of the petitioner in brief is that the petitioner herein land under Sy.No.132 of Mandal, Medak District, for Which they have obtained necessary permissions and a service connection from the competent authority. Since there are arrears due in payment of service charges to a tune of Rs.7,86,306/-, respondent No.2 issued proceedings vide Lr.No. D.No. 453/24 dated t3.12.2024 directing the petitioner to pay the said amount in three (03) instarments. The petitioner paid the first instarment of Rs.3,00,000/- on the same day i.e., on 13.12.2024 and the petitioner has to pay the second installment on or before 72.01.2025, however, the respondents disconnected the power prior to the second installment itself. 6. Learned counsel appearing on tiehalf of the petitioner submits that as per the proceedings of the' respondent No.2 dated t3.I2.2024 issued to the petitioner, the petitioner had deposited the first installment of Rs.3,00,00O/- on the same day i.e., on

13.L2.2024, however, respondents highhandedly disconnected the power supply on 17.L2.2O24, prior to the due date for payment of second installment itself i.e., 12.01.2025. 5q 4 SN,J wp_1201 2025 7. Learned counsel appearing on behalf of the petitioner further submits that he will abide by all the conditions as imposed in the proceedings dated 13.12.2024 and pay the CC arrears pertaining to the second installment of Rs.2,43,153/- within one week from today i.e., from 20.01.2025

Learned Standing Counsel appearing on behalf of the respondents submits that upon the petitioner complying with the instructions issued vide proceedings dated 13.12.2024, the respondents would forthwith restore the electricity service connection i.e., HT Service No.MDK2521 which belongs to the petitioner crushing unit situated in the land under Sy.No.132 of Lingareddypet Village, Manoharabad Mandal, Medak District.

Takino into consideration: a) The submissions made by the learned counsel appearing on behalf of the petationer.and, b) The submissions made by the learned Standing Counsel appearing on behalf of the respondents, The writ petition is disposed of directing the petitioner to deposit an amount of Rs.2,43,153/-(Rupees Two lakhs forty three thousand one hundred and fifty three only) pertaining to the second installment due te-be paid by the I I CEE wp_t 20t_2025 petitioner as per the proceedings of the respondent No.2 dated 13-12-2024 addressed to the petitaoner herein within a period of one week from today i.e., 2O.OL.2O2S and upon the petitioner depositing the said due amount pertaining to the second installment, the respondents shall forthwith restore the power supply connection to HT Service No.MDK2521 belonging to the petitioner.s crushing unit situated in the land under Sy.No.132 of Lingareddypet Village, Manoharabad Mandal, Medak District. The petitioner is further directed to compty with the instructions issued by the proceedings dated tg.tZ.2O24 and pay the third installment of Rs.2,43,153/-(Rupees Two takhs forty three thousand one hundred and fifty three only) on or before L2.O2.2O25, failing which, the respondents shall take due course of action against the petitioner.
