BHASKAR REDDY WRIT PETITION No.12O2 of 2o25 ORDER This writ petition is filcd seeking to declare the action of respondent Nos:4 and 5 in demolishing the foundation footing and damaging the iron roads and interfering in the construction activity illegalty despite there being:r valid permission taking by the petitioners from the HMDA vide building permit No.o04656/BP/HMDA/toOSlGtfT/2024, dated 30.r1.2024 without notice and without an_v au thority, as illegal and arbitrary and consequently praved lor other approiriate reliefs.
2. Considered the submissions of the learned counsel for the respective parties and u,ith thcir conscnt this writ petition is being disposed of at thc admissior-r stage.

It is stated that the petitioners are the owners and possessors of open plot No.tr/313, in Sy.No. 12, 13, V+ of 19 to 2 1, admeasuring 36O sq. yards, situated at Parvathapur Village, Medipally Mandal, Medchal Malkajgiri District, having purchased the same through registercd sale deed bearing document No.11259 ot '2023, dated 22.11.2023. It is further stated that they have obtained pcrmission lor construction of \ -... 2 CVBR.,I wp l2{)2 2025 rcsidcnti:rl house i.e., stilt + 5 uppcr floors from IIMDA uide building pcnnrt No.O04656/BP/HMDA/ 1008/GI{T / 2024, datcd
30.11.2O)4 and as per the said permission, they have mortgage d certzrin propcrty vide document No. lOA97 12024, datcd 2:1.11.2024 in favour of Commissioner, Hyderabad Metropolitan Development Authority, in respect of 107o of the total br-rilt up area. The case of thc petitioners is that respondcrtt Nos.4 and 5, without issuing any noticc artd without following thc plocedure as prescribed in law, are intcrlering with their posscssion and also removed part of the constructed area.

Admittedly, the petitioners have purchased open plot No.E/313, in Sy.No. 12, 13, % of 19 to 21, admeasuring 36O sq. yards, situated at Parvathapur Village, Meclipally Mandal, Medchal-Malkajgiri District, through registered sale deed bearing document No.11259 of 2023, dated 22.1 1.2023 and have also obtained building permission for construction of residential house i.e., stilt + 5 upper floors from HMDA uide building permit No.004656/BP/HMDA/ I 008/GHT / 2024, dated
30.71.2024. In terms of the said building permission, they have mortgaged certain property vide document No.10897 12024, dated 23.I1.2024 in favour o[ Commissioner, Hyderabad Metropolitan Development Authority, in respect of 1O7o o[ the total built up area. Pima focie, the pelitioners have satisfied that they are having valid documents strictlf in accordance with the permission gralted by HMDA. 7. In Rajendra Kumar Barjatya and another vs. U.P. Avas Evam Vikas Parishad and others2, the Hon'ble Supreme Court while observing that constructions put up in violation o[ or deviation from the building plan approved by the local authority and the constructions which are audaciously pit up without any building planning approval, cannot be encouraged, has issued following directions: "21. In view of the above discussion, this Court is the opinion the larrv laid dou,n by the Hon'ble Supreme Court in the above judgments is squarely applicable to the facts of the present case as the respondents without issuing any notice, are interfering with the possession of the petitioners and also removed part of the constructed area. Since the Hon'ble Supreme Court specifically directed all the State Governments throughout the country to follow the guidelines issued for removal of alleged unauthorized and itlegal constructions, following the samc, this Writ Petition is disposed of directing the respondents not to interfere with the construction activity of the petitioners rT'ithout t0 CVI]R.
