ORDER:
This Criminal Petition under Section 482 Cr.P.C. is filed by the petitioner Polasa Satyanarayana – accused seeking for a direction to the Additional Judicial Magistrate of First Class, Jagtial to receive the interlocutory petitions i.e. for (i) summoning7 the petition mentioned witness as a Court witness to give evidence and specimen handwritings for comparison, and (ii) appointment of Advocate- Commissioner to record the evidence of the petition mentioned witness i.e. handwriting expert in C.C. No.56 of 2008 (Old C.C. No.117 of 2000).
Heard.
Grievance of the petitioner is that the learned Magistrate is not receiving the applications filed by the petitioner (i) for summoning a witness as a Court witness to give evidence and specimen handwritings for comparison and (ii) for appointment of an Advocate- Commissioner to record the evidence of the handwriting expert.
C.C. is of 2000, though it is renumbered in 2008.
Considering the facts and circumstances of the case, it is directed that the learned Magistrate shall receive the above referred petitions filed by the petitioner, if they are otherwise in order, and dispose of the same on merits in accordance with law.
