SREENTVAS RAO WRIT PETITI ONN0.541 OF 2025 ORDER: The grievance o[ the petitioners is that the petitioners . submitted an application/representation dated 23.09.2024 under Section 3G(5) of rhe National Highways Act, 1956 (hereinafter referred to as "the Act, 1956") requesting respondent No.3 to refer the same to respondent No.2 on the ground that respondent No.3 passed an award No.A/250/22, dated I1.03.2024, by granting meager compensation, and the petitioners are entitled to seek enhancement of cornpensation in respect of the subject property acquired by the respondent authorities. In spite of repeated requests rnade by the petitioners, the respondents have not taken any steps. The same is contrary to the provisions of the Act.
2. Heard Mr. B.Arjun Rao, learned counsel for the petitioners, Mr. Laxmi Narayana, leamed Assistant Government pleader for Land Acquisition appearing for respondent Nos. I to 3, and learned Assistant Governmenl Pleader for Roads and Buildings appearing for respondent No.4 and Mr. K.Aravind Kumar, learned Standing Counsel appearing for respondent No.5. 2
3. With the consent of the learned counsel, for the parties, the present writ petition is disposed of at the stage of admission.
4. Leamed counsel for the petitioners submits that the petitioners have submitted an application/representation dated 23.09.2024 invoking the provisions of Section 3G (5) of rhe Acr, 1956, not satisfied with the compensation determined by respondent No.3 in rhe award dated I L03.2024, seeking a reference to respondent Nos.2 and 3 and the sa id application/representation is pending before respondent No.3.
5. Learned Assistant Government pleader for Revenue, basing upon the oral instructions given by respondent No.3, namely the Revenue Divisional Officer, Kollapur, Nagarkurnool District, submits that the respondents have already referred the application/representation dated
23.09.2024 submitted bv the petitioner to respondent No.2 and respondent No.2 will pass appropriate orders in accordance with law after issuing notice to the petitioners and an1l other affected parties as per the provisions of the Act, and requested this Court to grant reasonable time. l l 6- The above said submissions have not been disputed by leamed counsel for the petitioners

Having considered the rival submissions of the respective parties and taking into considerations the submissions made by the learned Government Pleader for Land Acquisition, it reveals that respondent No.3 has already ref'erred the application/representation dated 23.09.2024 submitted by the petitioners under section.3G(5) of the Act to respondent No.2 . In view of the same, respondent No.2 is directed to consider the application/representation dated, 23.09.2024 submitted try the petitioners invoking the provisions under Section 3G(5) of the Act and pass appropriate orclers in accordance with law, within a period of four (4) months from the date of receipt of copy of this order, after issuing of notice to the petifioners and any other affected parties. 4
8. With the above directions, the Writ petition is disposed of . No order as to costs". Pending miscellaneous petitions, if any, shall stand closed. SDI A.
