Counsel for the petitioners : M/s ACHYUTH BHARTHWAJ Counsel for the Respondents : AGp FOR REVENUE The Court made the following ORDER -l-ut HON'BLE SRI JUSTICE C.V.BHASKAR REDDY WRIT PETITION No.487 OF 2o25 ORDER: This writ petition is filed declaring the action of respondents in not considering the application, dated 08.06.2O24 submitted by the petitioners seeking for conducting survey of the land admeasuring Acs.1.230O gts., in Sy.No.660/AA, Ac.l.24OO gts., in Sy.No.660/AA-1, Ac. 1.O2OO gts., in Sy.No.660lE/A, Ac.1.O2O0 gts., in Sy.No.66OlE/A, Ac. 1.0300 in Sy.No.660/tr-1, thus total to an extent of Acs.O6.14 gts., and admeasuring Ac.01.00 gts., in Sy.No.660i E/A/2 situated at Kollampalle Village, Naraypet District, Telangana and Iixing the boundaries for the subject property, as illegal, arbitrary, unconstitutional and lor other appropriate reliefs.

It is stated that the petitioner No. 1 is the pattadar and possessor of the lands admeasuring Acs.O6.14 gts., in Sy.Nos.66OlA, 660/A-I, 660/E-1, 660/E/ A, bearing registered sale deed bearing document No.126l of 2014, dated 73.02.2014, and petitioner No.2 is the pattadar and possessor of the land admeasuring Ac.O1.OO gts., in Sy.No.66O/tr/A bearing registered sale deed document No.1920 of 2018, dated 21.O3.2O 18, situated at Kollampalle Village, Narayanpet District, Telangana- It is stated ') CVBR, J \Yp 481 2025 that the rcvenr-re authorities issued pattadar passbooks in lavour of the petitioners. It is the further stated that they are intending to h,x the boundary' stones for demarcating the subject property so as to maintain pr:eLce and harmony r.r,ith the owners of neighbouring lands, and petitroners made applications, dated 08.06.2r)24 and
23.12.2024 to conduct survey and demarcation of the subrect land and fix the botrndaries. The grievance of the petitioners is that even after re<:eiving the said applications, the respondent authorities are nol conducting survey and hxation of the boundarics.
3. Considered the submissions of the learned counsel for the petitioners, learned Assistant Government Pleader for Revenue appearing for the respondcnts and with their consent this writ petition is disposed of at the admission stage.
4. lrarned c ounsel for the petitioners has submitted that in terms of the circular issued by the Commissioner, Survey, Settlements anrl Land Records, the respondents are bound to consider the applicaLion within 45 days from the datc' of the application aftr:r collecting necessary charges.

Learned Assistant Government Pleader for Revenue appearing for the respondents has submitted that the respondent ,17 I I J CVBR, J wp 487 2025 authorities will consider the aforesaid applications submitted by the petitioners by lotlowing due procedure laid down under law and conduct survey and demarcate the subject land by fixing boundaries It is settled law that the Survey Department has the 6. authority to conduct survey and demarcate lands in accordance with the provisions of the Telangana Land Revenue Act' 1317 Fasli (Act No. VIII of 1317 Fasli), the Telangana Survey and Boundaries Act, 1923, and the Rules framed thereunder' The Government has issued various circulars specifying the conditions for conducting surveys, particularly F-Line (held measurement) surveys' Individuals requesting such surveys are required to submit specihc documents, and if the conditions stipulated in the circulars are fulfilted, the survey and boundary fixation may be conducted' The Commissioner, Survey, Settlements and.Land Records' exercising powers under the Telangana Survey and Boundaries Act' 1923' time vide issued relevant circulars from Rc.No.N1/6543/99, dated 25'O7 '2OOl, Rc No'N1/ l4O8/07 ' dated' 13.O7.2OO7, and Rc.No.N2/174 ll2OlO, dated 18'05'20lO stipulating the conditions for conducting survey of private lands and as per the said circulars, if the petitioner fulhls all the conditionsofthesaidcircular,itisanobligationforthe 1 CVBR, J w?_487 2025 r'1 respondents to conduct survey within the time specified in the said circulars.
7. In view tf the aforesaid discussion, this Court deems it appropriate to dispose of this writ petition directing respondent Nos.2 to 5 to examine the petitioner's applications dated
08.06.2024 ancl 23. 12.2024 submitted for conducting sunrey and demarcation by fixing boundary stones of the subject land and if the petition<:rs fulfils all the conditions mentioned in the circulars issu,:cl by the Commissioner, Survey, Settlemcnts and Land Records from time to time, after issuing notices to all the persons interes[ed ancl adjacent pattadars and after considering their objections, respondent Nos.2 to 5 shall conduct survey of the aforesaid land within a period of eight (8) weeks from thc date of receipt of a copy of this order.
