LAKSHMAN WRIT PETITION No.35449 of2024 ORDER: Heard learned counsel appearing for the petitioners, learned Assistant Government Pleader for Municipal Administration and Urban Development appearing for respondent No. 1, learned Assistant Government Pleader for Revenue appearing for respondent No.2 and Sri M. Ram Mohan Reddy, learned standing counsel appearing for respondent Nos.3 and 4. Perused the record, In view of the nature of relief sought by the 2. petitioners, this Writ Petition is disposed of at the admission stage dispensing with notice to respondent No.5.

3. Petitioners and respondent No.S are residents of Thirumalgiri area, Suryapet Municipa-lity. Respondent No.S is making construction by damaging the C.C. road and also occupying the 5 feet road without leaving JKL, W.P.No.35449 of 2024 2 setbacks. Therefore, tlre said construction of respondent No.5 is un-authorized and illegal. Petitioner has submitted a representation dated LO-O7.2024 to respondent No.3 with a request to take action against respondent No.5. Despite receiving and acknowledging the said representation, respondent No.3 did not act upon the sarne. Aggrieved by the said inaction of respondent No.3, petitioner hled the present Writ Petition.

4. Whereas, Sri M. Ram Mohan Reddy, Iearned Standing Counsel appearing for respondent Nos.3 and 4, on instructions, would submit that on receipt of the representation dated LO.O7.2024, respondent No.3- Municipality inspected the subject property

06.12.2024. Respondent No.3 is on leave and he will take lurther steps, strictly in accordance with the procedure laid down under the Telangana Municipalities Act, 2019, by putting the petitioner and respondent No.5 on notice and affording them an opportunit5r of personal hearing. In view of the said submission, this Writ petition is disposed of directing respondent No.3 to consider the representation dated IO.OZ.2024 submitted by the petitioner and take action against respondent No.5, stricfly in accordance with procedure laid down under the, Telangana Municipalities Act, 2OI9, by putting the petitioner and respondent No.S on notice and allording them an opportunigr of personal hearing. He shall complete the said exercise within a period of four (4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
