Complaining violation of the orders of this Cou-t dated 19.10.2023 pa:;sed in I.A.No.1 of 2023 in W'P'No'28571; of 2023' the petitioner preferred the present Contempt Case' 3 Thi Cou rt, vi e its orde dat d 19.10.?9_23jD. It is the sPecific case of the Petitioner is that, inspite of the petitioner's representations dated 2t;-Ol- 2022, 76-09-2022 and 2l-02-2023 addressed to the 2nd rer;pondent herein seeing release of amctunts legally clue to the petitioner for having availed petitioner's Transport services on a running ac(:ount for the period September, 2015 to November, 2OL6, yet there has been no action Initiated on behalf of 2nd I I I I I i I I i ! Taking into the consideration the above said submission, the 2nd respondent herein- is directed to consider the petitioner,s representations dated LS_OL_ 2022, 16-09-2022 and 2I-02-2023 seeking retease of the due amount to a tune of Rs.20,L2,2421_ for the Transport services rendered by the petiiloner within a period of two (02) weeks from the date of receipt of the copy of this Order and duly communicate the decision to the petitioner herein. Learned counsel appearing on behalF of the petitioner submits that in pursuance to the interim orders of this court dated 19.10.2023 passed in I.A.No.1 of 2023 in W.p.No.2B575 of 2023, the respondent issued proceedings No.117/DM(proc)/ DGM(prod)/2024, dated 17.o}.2oz4 to the petitioner informing him that the representation of the petitioner seeking payment of transportation bills to a tune of Rs.20,12,242/_ had been considered and payment of Rs.6,13,118/_ would be released as the services of the petitioner was utilized by TSDDCFL i.e., after formation of TSDDCFL during period 01.06.2016 to November, 2016. Hence, the TSDDCFL have to release F.s.6,13,118/- But the amounts pertaininl; to the TSI)DCFL are under freeze. However, pursuant to the interim orders of the Hon'ble High Court dated 19-03-;102-3, we may release the said amount ol' Rs 6,13,116/- to M/s. R.K. Transport from TGDDC:FL account. Presently the Combined accounts of APDDCFI- final Audit for the period 01'04'2018 to 31.05.i1()16 is under finalization, after completior of the fina audit and receipt of the TGDDCFL share from the Frozen account the same shall be reimbursed to TGDDCFL account. Therefore, .pursuant to the interim orders of the Hon'ble High Court dated 19-10-2023 in WP NO' I I A SN, J cc 8t 2025 28575/2023, your representations for payment of transportation bills to a tune of Rs. 20,12,242/_ has been considered, and payment of Rs. 6,13,118/- will be released as the services of Mis RK Transport was utilized by TSDDCFL ie after formation of TSDDCFL during period 01.06.2016 to November, 2016 However, the balance amount payment will be considered, on finalization of Audit issues of Federation. Accordingly, your representations dated 25.07.2022, 16.09.2022 & 2t.02.2023 are hereby disposed off."

A bare perusal of the contents of the proceedings dated 17.08,2024 issued to the petitioner in comptiance to the directions of this Court dated lg.lO.ZO23 passed in W.P.No.28575 of 2023, clearly indicates that an amount of Rs.6,13,118/- would be released to the petitioner and after completion of final audit and receipt of the TGDDCFL share from the frozen account, further amounts would be.released to the petitioner and the balance amount payment would be considered on finalization of audit issues of federation and hence, this Court opines that there is no contempt as alleged by the petitioner. 8. Takinq into consideration: a) The aforesaid facts and circumstances of the case, -t- .
