Heard Mr.K.K. Trivedi, learned advocate appearing for the petitioners, Mr.S.P. Hasurkar, learned advocate appearing for the respondent nos.1 and 2 and Mr.Ayaan Patel, learned A.G.P. appearing for the respondent nos.3 and 4.
The petitioners herein are in possession of the land bearing Block no.51 (Revenue Survey No.50) of Village: Bonand, Taluka: Choryasi, District: Surat admeasuring approximately 16,289 sq.mtrs.
Mr.K.K. Trivedi, learned advocate submitted that the respondent no.2 has laid the overhead transmission line in February, 2019 however, though the land in question was acquired by the competent authority, the compensation with respect to the land bearing Block No.51 of Village: Bonand, Taluka: Choryasi, District: Surat on which, 66 KV HT transmission lines and transmission towers are installed, is not paid to the petitioners. Mr.S.P. Hasurkar, learned advocate appearing for the respondent authority, upon instructions, submitted that if an application would be preferred by the petitioners seeking compensation with respect to the land bearing Block No.51 of Village: Bonand, Taluka: Choryasi, District: Surat wherein, the petitioners are in occupation on which, transmission lines and the transmission towers are laid, the same would be considered by the competent authority under Section 16(3) of the Indian Telegraph Act read with Section 67 of the Electricity Act, 2003.
In light of the statement made by Mr.S.P. Hasurkar, learned advocate appearing for the respondent nos.1 and 2, if the petitioners were to prefer an application seeking compensation to the respondent nos.1 and 2, the same be considered by the respondent authority under Section 16(3) of the Indian Telegraph Act read with Section 67 of the Electricity Act, 2003 in accordance with law as expeditiously as possible.
