1.(cid:9)Heard the ld. advocate Mr. PM Vyas for the appellant and Mr. HL Jani ld. APP for the respondent-State.
2.(cid:9)This matter was fixed by the office on running final hearing Board of this Court on 27.9.2004. Ld. APP was requested to obtain jail remarks of the appellant in view of short sentence.
3.(cid:9)The present appellant was convicted by the ld. Sessions Judge, Panchmahals at Godhra vide his judgment and order dated 6.5.1995 in Sessions Case No. 159/1994.
4.(cid:9)Today, ld. APP places on record a communication addressed to him by the Sub Jailor, Baroda Central Jail stating that the present appellant - Ramdas Punitdas Sadhu who was convicted under sec. 20(b) of the Narcotic Drugs & Psychotropic Substances Act, 1985, has served his sentence awarded to him and has been released from jail on 13.9.1999. The said communication is taken on record.
5.(cid:9)Since the appellant has served the sentence awarded to him and has been released in the year 1999, this appeal has now become infructuous and is required to be disposed of.
