Judgment
(Per D.M. Dharmadhikari, C.J.) (cid:9)From the prayer clause of the petition, it is clear that this Service matter is pertaining to nomination of the members of the petitioner-Association, i.e. Gujarat Forest Service (Gazetted) Association, to Indian Forest Service on the basis of their alleged rightful quota. The petitioner has also raised a question of vires of the I.F.S. Recruitment Rules. The entire service matter clearly is within the exclusive jurisdiction of the Central Administrative Tribunal under Section 14 of the Administrative Tribunals Act, 1985. (cid:9)We, therefore, dispose of this petition, with liberty to the members of the petitioner-Association in this service matter to approach the Central Administrative Tribunal. Since under some legal misconception, this petition was entertained by this Court and an interim order is operating since September
Operative part
29, 1988, we direct that the interim order made by this Court shall continue for a period of one month, within which time the members of the petitioner-Association may approach the Central Administrative Tribunal for obtaining necessary reliefs. As the petition was entertained and was pending in this Court since the year 1988, we direct that if the members of the petitioner-Association approach the Central Administrative Tribunal in the same subject matter within (cid:9) (cid:9) (cid:9) (cid:9) (cid:9) a period of one month, the Tribunal shall not set up the bar of limitation. (cid:9)This Special Civil Application is disposed of with the above direction. Rule is, therefore, discharged, but in the circumstances, with no order as to costs. 22nd February, 2000(cid:9)( D.M.
