08.12.2023 The instant application has been filed under Order 41 Rule 5 Page No.# 2/2 of the Code of Civil Procedure, 1908 seeking stay of the award dated 31.05.2022 passed in MAC Case No. 12/2020 by the learned Member, Motor Accident Claims Tribunal, Mokokchung, Nagaland. This Court, upon hearing the learned counsels appearing on behalf of the applicant as well as the respondent No. 1 and also taking into account that the accompanying appeal has been admitted, stay the impugned judgment and award dated
31.05.2022, passed in MAC Case No. 12/2020 by the learned Member, Motor Accident Claims Tribunal, Mokokchung, Nagaland, subject to a deposit of 50% of the awarded amount on or before
19.01.2024 before the Registry of this Court. This Court further directs that upon deposit of the said amount before the Registry, the respondent No. 1 would be at liberty to file an application before the Registry for release of the said amount. The Registry shall, on such application so filed by the respondent No. 1 release the said amount in favour of respondent No. 1 after carrying out the necessary verifications.
