Angami, learned Govt. advocate appearing for respondent nos. 1, 2 and 4, Mr. C.T. Jamir, learned senior counsel assisted by Mr. Aliba Ozukum, learned counsel for respondent no.3 and Mr. Yangerwati, learned CGC appearing for respondent no.5.

2. Common questions of fact and law arise for determination in all these writ petitions. The learned counsel and senior counsel for the appearing parties have jointly submitted that all this cases are tagged together and common orders are passed in these matters and therefore, they have jointly prayed that the matter be heard together by taking the record of W.P.(C) No. 269/2021 as the lead case. Accordingly, these matters have been heard together.

In brief, the case of the petitioners is that the petitioners in all these writ petitions were appointed as Part-Time Instructors (hereinafter referred to as PTI for short) and they were posted in different schools during the year 2015-16 in a fixed pay of Rs.10,000/- per month under the Sarva Shiksha Abhiyan programmes. The engagement was initially for a period of six months subject to further extension and it is projected that the services of the petitioners were extended from time to time. It is the case of the petitioners that in course of their service period, by a Page No.# 93/105 communication dated 27.08.2018, the fixed pay of the petitioners was reduced from Rs.10,000/- per month to fixed pay of Rs.7,000/- per month.

4. The under Secretary to the Govt. of Nagaland, Department of School Education, by a communication dated

29.05.2019, informed the Director of School Education, Nagaland that the fund provision has not been made to meet the salaries of the PTI in the Project Appraisal Board Outlay and accordingly, it was reiterated that no further extension beyond 30.06.2018 will be considered. Notwithstanding that the all Nagaland PTI (SSA) had represented before the Government for extension of their services, the Director of School Education, Nagaland, issued a notice dated

26.06.2019, informing all the PTIs that in pursuance to government directive dated 29.05.2019, no further extension beyond 30.06.2018 will be admissible.

5. Claiming that the petitioners were performing the duties till the month of June, 2019, the petitioners approached this Court and by filing WP(C) Nos. 158/2019 to WP(C) No. 168/2019, prayer was made for payment of salaries and extension of service. This Court disposed of those writ petitions vide separate orders dated

19.09.2019. The relevant portion of the said order dated 19.09.2019 is extracted below: “In view of the writ petitioners’ claim that they have rendered their services as part time employee with the respondent authorities for the period mentioned above, I deem it appropriate to dispose of this writ petition with a direction to respondent authorities, more particularly, the respondent Nos. 3 and 4, the Principal Director, Director of School Education, Kohima and the Mission Director, Page No.# 94/105 Nagaland Education Society, Kohima to verify as to whether the writ petitioners did actually render their services as part time employee for the period June, 2018 to June, 2019. If on such verification made it is found that the writ petitioners have actually rendered their services for the period mentioned above, the respondent authorities, more particularly, the respondent Nos. 3 and 4 shall release their salaries for the period mentioned above. The necessary verification as indicated hereinabove and the payment of salaries thereof, if entitled to, shall be completed within a period of 2 (two) months from today. Writ petition is disposed of in terms of the above.”

In these writ petitions, it is projected that a writ petition, being WP(C) 188/2019, was subsequently filed only for salary for the duties performed as the petitioners therein were under the impression that there was not fund provision for their salary or extension of service. The said writ petition was disposed of by order dated 21.10.2019. The said order is quoted below: “Heard Mr. Joshua Sheqi, learned counsel appearing for the petitioners and also heard Mr. N. Angami, learned Government Advocate appearing for the State respondents No. 1, 3 & 5. It is submitted by Mr. Joshua, learned counsel for the petitioners that the petitioners were appointed as part time instructors in different Schools under SSA between the year 2015-2016 and since the day of their appointment they have continued to work uninterruptedly till

26.06.2019 on which a notification No. ED/ SSAPTI/ EXTN/18/2017/747, dated 26.06.2019, was issued by the Additional Director, Directorate of School Education, Government of Nagaland which states that there would be no further extension of their service beyond 30.06.2019. It is also submitted by the learned counsel that the petitioners have no longer any grievance other than for the non payment of their salaries between 30.06.2018 till the date the notification stated above was issued i.e. 26.06.2019. Mr. Joshua submitted that since the Page No.# 95/105 petitioners were working continuously till the date the notification was issued they should be paid their salaries for that period. He also submitted that in similar cases filed by similarly situated persons, this Court had directed the State respondents to pay the salary of those persons for the period they were working, therefore, this writ petition may also be disposed of with the same direction. Mr. N. Angami, learned Government Advocate submits that this writ petition may be disposed of in line with the directions given in the writ petitions W.P.(C) No. 158/2019, W.P.(C) No. 159/2019, W.P.(C) No. 160/2019, W.P.(C) No. 161/2019, W.P. (C) No. 162/2019, W.P.(C) No. 163/2019, W.P.(C) No. 164/2019, W.P.(C) No. 165/2019, W.P.(C) No. 166/2019 W.P.(C) No. 167/2019 & W.P.(C) No. 168/2019. In view of the submissions of both the learned counsels and in view of the fact that the order dated 26.06.2019 was issued by giving retrospective effect, the respondents are directed to pay the salary of the petitioners for the period between 30.06.2018 to 26.06.2019, if on verification, they are found to have worked during the same period. The writ petition stands disposed”

The petitioners project that they were mislead by communication dated 29.05.2019 by the under Secretary to the Govt. of Nagaland, Department of School Education wherein it was stated that fund position has not been made to make the salaries of the PTIs in the Project Appraisal Board outlay and that no extension beyond 30.06.2018 will be considered. Pursuant to above, the Director of School Education, Nagaland had issued notice dated

26.06.2019, discontinuing the services of the petitioners as PTIs beyond 30.06.2018. It is projected that the petitioners had doubted the stand of the State respondent and therefore, made RTI application and on receipt of RTI reply, to their shock they found that salary provisions have been made for payment to 2633 PTIs for Page No.# 96/105 the year 2019-20, 2020-21 and 2021-22 and that approval was made for a total fund of Rs.7193.52 crore which is inclusive of the salaries of the PTIs to the extent of Rs.5,31,72,000/- per year. Accordingly, it is projected that in 28 months till October, 2021, the State respondents had diverted and or misappropriated a sum of Rs.12,40,68,000/- at the rate of Rs.7,000/- per PTI per month.

8. Accordingly, by filing these writ petitions under Article 226 of the Constitution of India, the petitioners have made the following prayers: “A. Quash and set aside the letter No.DSE/SSA/APPT/ INSTRUCTORS/2012/499 dated Kohima the 29th May, 2019 (ANNEXURE-27) falsely declaring/claiming that the salary for PTI has not been made by the Project Appraisal/Approval Board outlay. B. Quash and set aside the Notice No.ED/SSA- PTI/EXTN/18/2017/747, dated Kohima the 26th June, 2019 (ANNEXURE- 29) denying extension of service to the petitioners. C. Direct the Chief Secretary to constitute an enquiry committee to enquire into the mismanagement/diversion/misappropriation of the salary of the petitioners. D. Direct the State Respondents to reinstate the services of the petitioners' w.e.f. July 2019 with all pay consequential benefits till reinstatement. E. Direct the State Respondents not to disturb the services of the petitioners so long as the funding under Samagra Shiksha continues.”

The learned counsel for the petitioners has meticulously referred to the writ petitions, affidavits exchanged by the parties and documents appended thereto in support of his contention that in the previous round of litigation, the State Government has mislead not only the petitioners but also this Court by suppressing material facts that in the project approval board by the minutes of Page No.# 97/105 meeting held on 07.05.2019 had approved the annual work plan and budget for the year 2019-20 under Samagra Siksha for the State of Nagaland which included salary for 211 Art Education PTI, 211 Health and Physical Education PTI and 211 any other PTI, totalling 633 PTI with financial support of Rs.5312.72 lakh.

The learned counsel for the petitioners has submitted that on having approval of the annual plan for 2019-20 of Samagra Siksha for the State of Nagaland with further budgetary support for the year 2019-20 and 2020-21 for similar amount, there was no justification for the School Education Department to terminate the service of the petitioners beyond 30.06.2018. It was submitted that assuming that there might have been a default on part of the Department of School Education and Literacy, Ministry of Human Resource Development, Govt. of India in making full payment of the approved amount of Rs.5312.72 lakh, the Director of School Education, Nagaland could have discontinued engagement of some PTIs but they could not have terminated all the PTIs when they were receiving funds from the Govt. of India for payment of salary to PTIs. Hence, it was submitted that notwithstanding that the hereinbefore referred communication dated 29.05.2019 was placed in the earlier batch of writ petitions, the prayers made in these writ petitions were not hit by the principles of res judicata because this is a case where the State respondents had presented an incorrect fact in the earlier round of writ petitions, which was later on found to be false. It was also submitted that the State respondents have targeted only the PTIs and discontinued their service whereas all other categories of teachers are continuing in service and receiving their salaries and accordingly, it is submitted that the petitioners have been discriminated against by the State respondents. 11. The learned senior counsel for the respondent no.3 has raised a preliminary issue of maintainability of these writ petitions on two grounds. Firstly that the notice dated 26.06.2019 regarding discontinuation of extension beyond 30.06.2018 was challenged by filing WP(C) Nos. 158/2019 to WP(C) No. 168/2019 which was all disposed of by order dated 19.09.2019 without granting them any relief save and except payment of salary for the period from June 2018 to June, 2019. Secondly, on the ground that the prayer in WP(C) 188/2019 was only for salary between 30.06.2018 to

26.06.2019 and that in the said writ petition, a specific stand on behalf of the petitioners has been recorded in the order dated

21.10.2019 to the effect that the petitioners have no longer any grievance other than for non-payment of their salaries between

30.06.2018 to 26.06.2019. Accordingly, it is submitted that the present writ petitions were barred by the principle of estoppel and res judicata. It was submitted that in the minutes of the meeting of the Project Approval Board held on 07.09.2019, on which reliance is placed by the petitioners, it was clearly stated as follows- “An amount of Rs.7193.52 lakh was estimated as support for teacher salary as per norms of the scheme, including 633 contractual instructors/ teachers. State was advised to relook at the requirement of teacher/ headmaster posts and rationalise deployment of teachers as all teachers are the responsibilities of the State. There is no dual cadre of teachers- only financial support for additional teachers salary would be provided under the Samagra Siksha. Any additionality as per terms and conditions for recruitment of the teachers in State is to borne by the State.” Page No.# 99/105 12. The learned senior counsel for the respondent no.3 has submitted that a specific stand taken in the affidavit in opposition filed by the respondent no. 3 is that the discontinuation of the service of the petitioners was done by order dated 25.09.2019, issued by the Director of School Education, Nagaland due to fund constraint for payment of their salaries. It was further submitted that a specific stand was taken that in most of the cases, the fund released to Nagaland Education Mission Society was much lesser than the fund approved by the Project Appraisal Board (also called Project Approval Board) and thus, discontinuation of service of the petitioner was sought to be justified. It was further submitted that the respondent no.5, through the under Secretary, Ministry of Education, in their affidavit-in-opposition has taken a specific plea that salary and service conditions of PTIs fall under the domain of the State Government and that by filing additional affidavit, the respondent no.5 has vindicated the stand of the State respondent no.3 that the actual central disbursement was less than the total outlay.

13. The learned CGC as well as the learned Govt. advocate for respondent nos. 1, 2 and 4 have both supported the submissions made by the learned senior counsel for respondent no.3.

14. In connection with the record of the lead case, i.e. W.P. (C) 269/2021, perused the writ petition; affidavit-in-opposition by respondent nos. 1, 2 and 4; affidavit-in-opposition by respondent no.3; affidavit-in-opposition by respondent no.5; two additional affidavit-in-opposition by respondent no. 5; affidavit-in-reply by the petitioner against affidavit-in-opposition filed by respondent no.3; affidavit-in-reply by Mission Director, Samgra Siksha (respondent Page No.# 100/105 no.3) against to the additional affidavit-in-opposition by respondent no.5.

In respect of the relief claimed vide prayer (B) of W.P.(C) 269/2021, it is seen from the orders dated 19.09.2019, passed by the coordinate Bench of this Court in WP(C) Nos. 158/2019 to WP(C) No. 168/2019 that the notice bearing no. ED/SSA- PTI/EXTN/18/2017/747 dated 26.06.2019, issued by the Director of School Education, Nagaland to the PTIs was under challenge in the said series of writ petitions. Therefore, the said prayer having been rejected, the prayer (B) of these writ petitions are barred under the principles of res judicata, as the said prayer was directly and substantially in issue in the previous series of writ petitions. In this regard, it may be stated that the Supreme Court of India in the case of Samir Kumar Majumdar Vs. Union of India & Ors., (2023) 0 INSC 836: (2023) 0 Supreme (SC) 975 has held that in interest of the State there should be end of litigation and no party ought to be best twice in a litigation for one and the same cause.

16. The learned senior counsel for the respondent no. 3 had pointed out that on behalf of the petitioners in W.P.(C) No. 188/2019, a clear stand was taken before this Court to the effect that the petitioners had no grievance other than for non-payment of their salaries between 30.06.2018 to 26.06.2019, which was a relief granted to them. Thus, the Court is of the considered opinion that the prayers made in this writ petition are hit by the principles of constructive res judicata, as per the principles of Explanation IV to section 11 CPC. It is no longer res integra that the said provision applies to a writ petition as successive writ petitions cannot be filed for one relief and again for another relief on the ground of omission Page No.# 101/105 to make all prayers in earlier writ petition. If one requires any authority on the point, reference may be made to case of State of Orissa Vs. Laxmi Narayan Das (Dead) through LRs, (2023) 0 INSC 619: (2023) 0 Supreme (SC) 629, and the case of M.J. Exporters Pvt. Ltd. Vs. Union of India & Ors., (2021) 13 SCC 343. It may also be stated that the previous set of litigations were filed to challenge the notice dated 26.06.2019. The government directives vide communication dated 29.05.2019 was mentioned in the said notice dated 26.06.2019. From the order dated 19.09.2019 referred above, it is not known whether the said communication dated 29.05.2019 was assailed by the petitioners or not. Assuming that the petitioners had not assailed the said government directives vide order dated

29.05.2019, that no further extension beyond 30.06.2018 will be considered, as the said notice dated 26.06.2019 contain reference to government letter dated 29.05.2019, the principles of waiver would also come into the play. In the case of Associated Hotels of India Ltd. Vs. S.B. Sardar Ranjit Singh, AIR 1968 SC 933, it was held by the Supreme Court of India to the effect that a waiver is an intentional relinquishment of a known right and that there can be no waiver unless the person against whom waiver is claimed had full knowledge of his rights and facts enabling him to take effectual action for enforcement of such rights. In the present case in hand, in view of the contents of notice dated 26.06.2019, which is assailed in prayer (B), the petitioners had the knowledge of government communication dated 29.05.2019 as the same is referred in notice dated 26.06.2019. It may be mentioned that the prayer (A) is for quashing letter no. DSE/ SSA/APPT/INSTRUCTORS/2012/466 dated 29.05.2019. Therefore, Page No.# 102/105 the petitioners are not found entitled for relief in terms of prayer (A) made in the writ petition.

17. Prayer (D) in the writ petition is to direct the State respondents to reinstate the service of the petitioner w.e.f. July, 2019 with all pay and consequential benefits till reinstatement. Prayer (E) is to direct the State respondents not to disturb the services of the petitioners so long as the funding under Samagra Siksha continues. In the said context, it may be mentioned that in the initial appointment orders of the petitioners, it was clearly mentioned that the initial engagement was made for a period of 6 months subject to further extension and it was also provided that the salary shall be borne by SSA, payable in March, 2015 and that next salary payment is subject to PAB approval 2015-16 of Sarva Siksha Abhiyan (SSA) Programme and release of fund from Ministry of Human Resource Development and it was also a condition of appointment order that the engagement was purely for a time period and liable to be terminated without prior notice and does not confer any right for regularization of service. It is not in dispute that the contractual appointment of the petitioners was not extended beyond 30.06.2018. However, they have received their salary up to June, 2019 pursuant to order dated 19.09.2019 in WP(C) 158/2019 and connected cases, which was subject to verification that the petitioners had actually rendered service between June, 2018 to June, 2019. Therefore, the contract between the Director of School Education, Nagaland and the petitioners, in its nature, was determinable. In this regard, we may refer to the provisions of Section 14(d) of the Specific Relief Act, 1963, which provides that the contract which is in its nature determinable cannot be Page No.# 103/105 specifically enforced. Therefore, as the part-time service of the petitioners as PTIs had been discontinued w.e.f. 30.06.2018, which can be deemed to have been extended till 26.06.2019 in light of order dated 21.10.2019 in WP(C) 188/2019, the Court could not have powers to reinstate the petitioners into service and create a contract of personal service when there is none. Resultantly, the petitioners are not found entitled to prayer (D & E) of the writ petitions.

18. The prayer (C) in this writ petition is to direct the Chief Secretary to constitute and enquiry committee who enquired into the mismanagement/ diversion/ misappropriation of salary of the petitioners. In this regard, we find from the contents of the additional affidavit filed by respondent no.5 on 14.09.2023 is that though the outlay including spill over for the year 2019-20, 2020-21 and 2021-22 was Rs.227.05 crore, Rs.210.74 crore and Rs.234.6 crore respectively and the proposed central release was Rs.159.37 crore, Rs.118.78 crore and Rs.118.78 crore respectively, actual central release for the year (a) 2019-20 was Rs.119.19 crore, (b) 2020-21 was Rs.107.44 crore and (c) 2021-22 was Rs.83.73 crore respectively. Accordingly, it is seen that though the approved outlay was much higher, actual central release of funds to the State of Nagaland was on the lower side. Therefore, insofar as release of sum of Rs. 119.19 crore for the year 2019-20 for elementary education is concerned, we find that the stand of the Mission Director, Samgra Siksha in his affidavit-in-reply is in consonance with the stand taken by respondent no.5 in Annexure-Y to his additional affidavit filed on 14.09.2023. Under such circumstances, the Court is of the considered opinion that there is no requirement for any Page No.# 104/105 enquiry to be made in respect of the alleged projection of mismanagement/ diversion/ misappropriation as projected by the petitioners, as such conditions prima facie does not exists. In the minutes of meeting of Project Approval Board held on 07.05.2019, at pp.216 of the writ petition, the Project Approval Board had clearly instructed the Govt. of Nagaland that only financial support of additional teacher salary would be provided under the Samagra Siksha and that in respect of 633 contractual instructors/ teachers, the State was advised to have a re-look at the requirement of teacher by making it clear that all the teachers are the responsibility of the State. In Annexure-Z, the additional affidavit filed by respondent no.5, it is clear that the support of salary of teacher would be provided to the States as a lump sum grant and not on the basis of number of teachers and it was made clear that all teachers are ultimately the responsibility of the State government. In the affidavit-in-opposition filed by respondent no.5, it was made clear that the Project Approval Board did not decide the remuneration paid to the different category of staff and that it prepared the estimate based on the proposal of the State as per schedule of norms and it was also specifically stated that there will be no separate teachers sanctioned by the Central Govt. and that all teachers are ultimately the responsibility of the State government and that the salary and service condition of Teachers and PTIs fall under the domain of the State government. Therefore, on the basis of materials produced by the petitioners, the Court is unable to record its satisfaction that there has been a mismanagement/ diversion/ misappropriation of the salary of the petitioners.

19. In any event the petitioners are contractual PTIs, who Page No.# 105/105 have no claim for regularization and their contractual service were terminated on 30.06.2018. There is no record of any formal extension of their services beyond the said period save and except dealing to be in service in terms of order dated 21.10.2019 passed in WP(C) 188/2019, the Court does not find the petitioners to be entitled to any relief as prayed for. Resultantly, these batch of writ petitions are found without any merit and all these writ petitions are dismissed.
