22.04.2026 ORDER Heard Shri B. Rahman, learned counsel for the petitioners. Also heard Shri S.S. Roy, learned State Counsel, Assam as well as Ms. P.R. Mahanta, learned Standing Counsel, Revenue Department, Assam. As per the facts projected, the petitioners, who are 50 in numbers, were allotted Government lands for making dwelling houses. However, due to river erosion, the petitioners were compelled to leave the lands from time to time. The claim of the petitioners was for issuance of patta. In the course of the proceeding, there was an order for referring the matter to mediation and the learned Mediator has furnished a report dated 03.02.2026. Perused the same. From the report, it transpires that the lands which were allotted to the petitioners are presently under the possession of unauthorised persons/encroachers and therefore, steps for issuance of patta in the name of the petitioners could not be taken. Page No.# 12/12 Both the parties were agreeable to pass necessary direction for surveying the land and handing over the same to the petitioners by evicting the unauthorised encroachers from the land. In view of the aforesaid development, more particularly, the report of the learned Mediator dated 03.02.2026, the instant writ petition is disposed of by directing the respondent authorities to take appropriate steps for evicting the unauthorised occupants/encroachers over the lands which were allotted to the petitioners and thereafter handover the possession of the same to the petitioners in accordance with law. The aforesaid exercise be undertaken expeditiously and preferably completed within a period of 90 days from the date of receipt of a certified copy of this order. The authorities would be at liberty to take further steps for issuance of patta which, however, has to be done strictly in accordance with law.
