AB 2151/2013 BEFORE HON’BLE MR.JUSTICE A.C. UPADHYAY This is an application under Section 438 CrPC seeking pre-arrest bail on behalf of the petitioner namely Safique Ul Alam @ Sofiqul Allom in connection with Goal para P.S. Case No.164 of 2013 under Section 406/420 IPC. Heard Mr. M. Biswas, learned counsel appearing for the petitioner and Mr. B.B. G ogoi, learned Addl. P.P. Perused the case diary. The allegation made against the petitioner is that despite taking advance amount , the accused person has not constructed the mobile tower. Apparently there is n o written agreement regarding execution of mobile tower. Besides this, the petit ioner namely, Safique Ul Alam @ Sofiqul Allom, was abducted by someone and he wa s subsequently rescued by the police. Accordingly, the prayer for pre-arrest bail submitted on behalf of the petitione r is allowed. Interim order passed by this Court on 23.5.2013 is hereby made absolute on the c ondition that the petitioner shall appear before the I.O. within 10 days from to day and shall cooperate with the investigation.
