JUSTICE ARUN DEV CHOUDHURY Date : 07-10-2022 ORDER Heard learned counsel for the petitioner and Mr. D. P. Goswami, learned Addl. P. P. Assam. This is an application made under Section 439 Cr.P.C. seeking bail to the accused petitioners namely, 1. Ritumoni Kalita and 2. Bikash Das who were arrested on 17.8.2022 in connection with Jalukbari P. S. Case No. Page No.# 2/2 471/2022 registered u/s 20(b) of the Narcotic Drugs and Psychotropic Substances Act (NDPS Act). Considering the period of detention as well as the intermediate quantity of the alleged seized cannabis, this court is of the considered opinion that no further custodial interrogation /detention is necessary for further investigation of the case. Accordingly, the petitioners, named above, shall be released on bail in connection with the case aforementioned on furnishing bail bond of Rs. 25,000/- each with one suitable surety each of the like amount to the satisfaction of learned Special Judge (NDPS Act) on the following conditions:
The petitioners shall not leave the territorial jurisdiction of learned Special Judge (NDPS) Kamrup, Guwahati Assam without prior written permission.
The petitioners shall not hamper with the investigation of the case and tamper with the evidence of the case,
