Heard Mr. S.C. Biswas, learned counsel appearing for the petitioners. Also heard Ms. A. Begum, learned Addl. P.P., Assam. Perused the case diary. By this application filed under Section 438 Cr.P.C. the petitioners, namely, (1) Sri Biren Deka @ Biren Kumar Deka & (2) Sri Jugal Deka have prayed for pre-arr est bail in connection with Pathacharkuchi P.S. Case No. 104/2013 U/s 341/326/30 7/506/34 IPC. The allegations made against the petitioners are that the petitioners on 29.03.2 013 at about 9:30 p.m., assaulted Sri Mrinal Roy, i.e., the son of the informant , by means of axe, dao etc. and thereby caused several injuries on his person. Having heard the learned counsel appearing for both the parties and considering the evidence collected by the investigating agency, I do not find it to be a fi t case to extend the benefit of pre-arrest bail. Hence the prayer for pre-arrest bail is rejected. Return the case-diary. The bail application is disposed of.
