AB 5337/2012 BEFORE HON’BLE MR. JUSTICE A.C. UPADHYAY This is an application filed under Section 438 CrPC seeking pre-arrest bail of t he petitioners, namely, Arju Acharjee and Ashok Chakraborty, in connection with CID PS Case No. 81/2012 under Section 120B/420/406 of IPC read with Section 4/5 of Prize Chits and Money Circulation Schemes Banning Act, 1978. Perused the case diary and materials on record. Heard Mr. BN Gogoi, learned counsel for the petitioners and Mr. BB Gogoi, learne d Addl. Public Prosecutor. FIR was lodged alleging non-refund of collected money of the depositors of Jeeva n Suraksha Group of Companies. The learned counsel for the petitioners submits that the petitioners were no lon ger working in the said organization at the relevant point of time and they are not at all involved with the financial matters of the Company. However, on perusal of the case diary and materials on records, I find s ufficient incriminating materials warranting custodial interrogation of the peti tioners in connection with the case. Accordingly, the prayer for pre-arrest bail submitted on behalf of the p etitioners stands rejected.
