Heard Mr N Uddin, learned counsel for the petitioner. Also heard Mr B S Sinha, learned Additional Public Prosecutor, for the State of Assam. Perused the Case Diary. By this application under Section 438 CrPC, the petitioner, namely, Sri Jintu Mani Das, has prayed for pre-arrest bail in connection with Bongaigaon PS Case No. 87 of 2012, under Section 420 of the Indian Penal Code, 1860. The allegation made in the FIR, alleged by the informant is that the pet itioner while working with the informant’s company received an amount of Rs. 38, 680/- from one of the customers and he did not deposit the said amount in the ac count of the Company. The learned counsel appearing for the petitioner has submitted that the allegation made against the petitioner that he received the money for the Compan y is false. Considering the entire aspect of the matter and the evidence on record, I find no necessity for custodial interrogation of the petitioner. Accordingly, the interim order dated 02.05.2012, is made absolute, subje ct to the condition that the petitioner shall appear before the Investigating Of ficer within 7 (seven) days from this date and on such other dates as may be so required. Return the Case Diary. The Anticipatory Bail Application stands disposed of.
