Judgment
This is an application under section 438 Cr.P.C., for granting pre-arres t bail to the petitioner, namely, Sri Jayanta Bhattacharya, who believes that he is being arrested by Police in connection with Paltan Bazar P.S. Case No. 351/2 009 under sections 120(B)/420/406/506 IPC. Though the case diary has not been produced by the learned Additional Pu blic Prosecutor, from the materials available on record, it can be seen that the case is of a civil nature. In view of the above, I think no custodial interroga tion is necessary. Under the circumstances, the interim bail is made absolute. I n the result, the petitioner, in the event of arrest, shall be released on bail on his executing a P.R. Bond of Rs. 20,000/- with one surety of the like amount to the satisfaction of the Arresting Authority. Bail application stands disposed.
