Perused the case diary. By this application filed under Section 438 Cr.P.C. the petitioner, name ly, Shri Uttam Acharjee, who is a General Manager of Jeevan Suraksha Group of Co mpanies, Lumding has prayed for pre-arrest bail in connection with Dotma P.S. Ca se No. 40/2012, under Sections 406/ 420/34 IPC. The allegations against the petitioner are that the petitioner and other s in the name of M/s. Jeevan Suraksha Group of Companies collected a huge amount of money from the various customers and misappropriated the same. Considering the evidence so far collected by the I.O. as well as the nat ure of alleged offences, I do not find it to be a fit case to extend the benefit of pre-arrest bail in favour of the petitioner. Accordingly, the prayer for pre -arrest bail is rejected. Return the case diary. The bail application is dismissed.
