24.08.2023. Heard Ms. P. Ghosh, learned counsel for the petitioner. Also heard Mr. B. Sarma, learned Addl. P.P., Assam appearing for the respondent State.

The bail application under Section 439 of the CrPC has been preferred by the petitioner, namely, Safiul Hoque @ Safiqul Hoque seeking bail in connection Page No.# 2/2 with Garchuk P.S. Case No. 102/2023, under Section 21(b)/22(c)/29 of the NDPS Act, who was arrested on 06.04.2023 and since then he has been in custody.

It is submitted by Mr. B. Sarma, learned Addl. P.P., Assam that the charge sheet vide C.S. No.153/23, dated 05.08.2023 has been filed in the case before the competent Court.

Ms. P. Ghosh, learned counsel for the petitioner submits on instructions that the petitioner does not wish to press the bail petition any further. Rather he seeks to file regular bail application before the competent Court.

Accordingly this bail stands dismissed, as not pressed.
