On the basis of the instructions so furnished by the District Magistrate, respon dent No. 4, Mrs. V. L. Sinha, submits that such permission has not yet been acco rded by the authority to the petitioner, inasmuch as, the clearance report from the SP of Police (Traffic) City. Guwahati has not been received. Although the petitioner duly applied to the Deputy Commissioner way back on 7-7- 2009 for according necessary permission to hold the Trade Fair in question and t he District Magistrate in its turn wrote to the Sr. SP of Police (Traffic) City ., Guwahati and although in the meantime almost two and half months have already elapsed, no such report has been submitted by the S.P. as called for. The instr uction so furnished by the learned counsel contains certain adverse remarks as a gainst holding of such fair in the Playground of Assam Engineering Institute, Ch andmari, Guwahati, but no such adverse remarks or report is there in respect of the Veterinary Playground, Khanapara where the 3rd International Trade Fair is p roposed to be held. Mr. Goswami has categorically submitted that the petitioner has no objection to hold such trade fair in the Maniram Dewan Trade Centre constructed by the State authorities in principle, but for want of necessary advertisement/publicity and for awareness amongst the concerned participants and the pe ople of the State the same could not be utilized in a short time by the petition er. It is contended that the petitioners could have considered for utilizing th e Maniram Dewan Trade Centre had there been due publicity well ahead of time and for not doing so, it is now not possible to change the venue which has already been progressed to a considerable extent. From the instruction so submitted I do not find any adverse remarks in holding t he trade fair in the proposed venue nor any doubt has been expressed from the se curity point of view. The Agricultural University has accorded the permission to the petitioners to hold the proposed Trade Fair. In such a situation since the District Magistrate has not expressed any doubt from the security point of view and in view of absence of any adverse remarks till date as well as from the subm issions made by the learned Sr. Counsel that the petitioner would take all neces sary steps whatever necessary and that may be directed by the concerned authorit ies for holding the trade fair, I do not find any reasonable ground to refuse th e no objection certificate to hold the proposed trade fair from the materials so made available before me, in the venue so fixed. In view of the above considerations, this writ petition stands disposed of with the direction that the Deputy Commissioner, Kamrup, Metro, the respondent No. 4 shall pass appropriate order to accord necessary permission to hold the proposed fair scheduled to be held from 7-10-2009 to 19-10-09, which is pending before him, forthwith. This order has been passed in view of the fact that there is very little time to hold the said trade fair on the scheduled date. Upon perusal of the records, it is seen that on earlier occasions also permission was accorded to hold such t rade fairs at Veterinary Playground, but after the actual starting of the fair. This delay undoubtedly causes difficulty and inconvenience to the organizer. In that view of the matter, the District Magistrate is directed to pass such ord er as indicated above well ahead of the scheduled date of the Fair. With order, this writ petition stands finally disposed of. The instruction so furnished by the learned State counsel is brought on record.
