Heard Ms. M. Hazarika, learned counsel appearing for the petitioner. The respon dent is represented by Mr. A.K. Gupta, Advocate. Since this application U/s.11 of the Arbitration and Conciliation Act, 1996 was earlier allowed through the judgment dated 23.08.2013, Justice Aloke Chakraborti , a Retd. Judge of Calcutta High Court is appointed as the Arbitrator to adjudic ate the dispute between the parties. Consequently, the counsel for both parties have agreed to instruct their clients to jointly appear before the Arbitrator o n 21.09.2013 as per the convenience of the learned Arbitrator. The terms may be decided by Justice Chakraborti before proceeding with the matter. The petition i s disposed of accordingly.
