This is an application U/s. 438 CrPC for granting pre-arrest bail to th e petitioners, namely, 1) Sri Deep Das 2) Sri Nabajit Das 3) Monuj Kakoty 4) Sri Hridoy Medhi 5) Sri Nibaron Talukdar 6) Sri Bakhistha Talukdar 7) Sri Sadananda Medhi 8) Sri Prafulla Das 9) Sri Dhaniram Das 10) Sri Probudh Kakoty 11) Sri An jan Das 12) Sri Sayta Das 13) Sri Girin Medhi and 14 Sri Pulin Talukdar, who ar e implicating in connection with Simla P.S.Case No. 13/13 U/s 448/376/302 IPC. O n going through the FIR as well as the case diary produced by the learned Addl. P.P.Assam, I am of the view that custodial interrogation of the petitioners is n ot called for. It is pointed out by the learned counsel for the petitioners tha t the named person in the FIR, namely, Sri Hari Nath Das has already been arre sted and detained in custody. On taking all factors into consideration, I am o f the view that the petitioners deserved to be released on pre-arrest bail. In the result, in the event of arrest, the petitioners shall be released on bai l on executing a PR bond of Rs.20,000/- by them with one surety each of the l ike amount to the satisfaction of the arresting authority. The petitioners are d irected to appear before the I.O. of the case within 7 days from today for reco rding of their statements.
