This application under section 438 Cr.P.C. has been filed by the petitioner, na mely , Tinku Kumar Agarwal praying for anticipatory bail apprehending his arre st in connection with Chabua Police Station Case No. 108 of 2012 under sectio n 408/468/380/34 of the IPC. Perused the case diary. The FIR has been lodged by the Circle Officer alleging the petitioner has withdr awn a sum of Rs.1,40,000/- on the basis of forged cheque. The petitioner’s case is that the accused Durga Changmai had taken loan of Rs.80,000/- from the petiti oner and to refund the said money, Durga brought one cheque and after encashment of the cheque, the petitioner retained his amount of Rs.80,000/- and returned t he balance amount of Rs.60,000/-. From the case diary, it appears that signature was forged by Durga Changmai. Fro m the FIR itself, it appears that Durga Changmai was involved in taking away som e cash money from the office. The above apart, Mr. Sahewalla submitted that Rs.1, 40,000/- has been withheld by bank. Hence, interim bail granted to the petitioner on 23.8.2012 is hereby made absolu te. The anticipatory bail application stands disposed of.
