Heard learned counsel for the petitioner as well as learned Standing Counsel for W.R. Department, Assam. By filing this application under Article 226 of the Constitution of India, the p etitioner who is a registered contractor has expressed his grievance against the failure of the Government to secure his outstanding bills against the contract work completed by him. The petitioner has furnished a list of work orders issued by the Government whic h have been successfully completed by him to the satisfaction of the authority. According to the petitioner, a sum of Rs. 6,58,652/- (Rupees Six lakh Fifty Eigh t thousand Six hundred Fifty Two ) only, is yet to be cleared although some amou nt have been paid to him from time to time. No affidavit-in-opposition has been filed by the Government and the amount has n ot been disputed. In a batch of petitions of similar nature a Full Bench of this Court passed a ju dgment on 29.09.2008 in the case of Tamsher Ali and Ors. vs. State of Assam and Ors., reported in 2008 (4) GLT 1, by providing certain guide lines for disposal of the claim of similarly situated persons and thereby all contractors were give n liberty to have their names registered in the concerned division and the Gover nment was directed to make payment of admitted amounts in chronological order on the basis of date of which payment is due and to discharge the admitted dues fr om the funds that may be received. In terms of the aforesaid judgment of the Full Bench of this Court this writ pet ition is also disposed of with a direction to the concerned authority for making payment of the unpaid admitted amount of Rs. 6,58,652/- (Rupees Six lakh Fifty Eight thousand Six hundred Fifty Two ) only within a period of 3 (three) months.
