Advocate for the Petitioner : MR. P DEKA Advocate for the Respondent : BEFORE HONOURABLE MR. JUSTICE DEVASHIS BARUAH Date : 20-07-2022 ORDER Heard Mr. P. Deka, the learned counsel for the petitioner. This is an application under Article 227 of the Constitution of India challenging the order dated 14.07.2022, passed in E.P. No.19/2019. The case of the petitioner in brief is that the petitioner was the contesting candidate for the post of President of No. 51 Sonaibera Simaluati Gaon Panchayat under the No. 6 Jarabari Alitangoni Zilla Parishad within the district of Nagaon, Assam from the political party of All India United Democratic Front and attained the second highest number of votes in the said Panchayat Election 2017-18. The records shows that the one Musstt. Nazma Ahmed had filed an election petition challenging the election of Mustt Anjuwara Ahmed, Page No.# 3/3 ( Respondent No. 4 herein) who was elected as the President of No. 51 Sonaibera Simaluati Gaon Panchayat under the No. 6 Jarabari Alitangoni Zilla Parishad. I have perused the said election petition and from the perusal of the said election petition, it transpires that the relief sought for is for setting aside the election of the respondent no. 4 herein and to hold a fresh election in respect to the said post of President of No. 51 Sonaibera Simaluati Gaon Panchayat under the No. 6 Jarabari Alitangoni Zilla Parishad. I have also perused the impugned order dated 14.07.2022, and on perusal of the said order, it reflects that there is no infirmity in the said order. Consequently, this Court having not found any grounds for interference under Article 227 of the Constitution of India, the instant petition stands dismissed. JUDGE Comparing Assistant
