Judgment
Heard Mr. Islam, learned counsel for the petitioner and Mr. Kamar, learn ed Public Prosecutor, Assam. The petitioner Md. Abu Sarif, by the present petition, is seeking the privilege of pre-arrest bail under Section 438 Cr.P.C in connection with Sipajhar PS Case No. 292/2011 registered under Section 498(A) IPC. Having heard the learned counsel for the parties and upon perusal of the materia ls available in the case diary, I am inclined to grant the privilege of pre arre st bail to the petitioner. It is accordingly directed that the petitioner, in the event of his arrest, in c onnection with the aforesaid police station case, shall be released on bail of R s. 15,000/- with two local sureties of like amount to the satisfaction of the ar resting authority on the following conditions: - 1. The petitioner shall make himself available for interrogation by the Investig ating police officer as and when required;
The petitioner shall not directly or indirectly make any inducement, threat o r promise to any person acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the court or to any police o fficer.
The petitioner shall not in any way hamper the investigation or tamper with t he evidence.
The petitioner shall not leave the State of Assam without written intimation to the Investigating Officer.
Operative part
