By way of this petition under Article 226 of the Constitution of India, petitioner seeks quashing of order dated 25.07.2011 passed by the Managi ng Director, Assam State Warehousing Corporation (Corporation) releasing the pet itioner from the service of the Corporation w.e.f. the date of tendering resigna tion i.e. 16.03.2011 and for a direction to the respondents to allow him to rejo in service in the Corporation. 3.

Facts of the case may be briefly noted. 4. Petitioner joined service in the Corporation as Warehouse Manage r, Grade-II on 16.11.1999. At the relevant point of time, petitioner was serving in the Head Office of the Corporation. 5. By letter dated 11.03.2011 petitioner informed the Managing Dire ctor of the Corporation (respondent No. 3) that he was offered party ticket by B haratiya Janata Party (BJP) to contest the Assam Legislative Assembly Election, 2011 from Batadrawa Constituency. He, therefore, requested respondent No. 3 to g rant him lien for 6 (six) months w.e.f. 16.03.2011 to enable him to the contest the election. Respondent No. 3 informed the petitioner vide letter dated 23.03.3 011 that no lien could be granted as the Assam State Warehousing Corporation (St aff) Regulation, 1989 does not have provision to allow its employees to contest in such election. 6. Petitioner wrote to the respondent No. 3 on 16.03.2011 submittin g his resignation from the post he was holding and requested the said respondent to accept his resignation with immediate effect i.e. 16.03.2011. 7. On receipt of the said application from the petitioner, responde nt No. 3 passed an order dated 06.04.2011 accepting the resignation tendered by the petitioner subject to repayment of the advance/loan amount that stood in the name of the petitioner and clearance of dues/liabilities towards the Corporatio n. 8. According to the petitioner, he was not in a position to refund the money which stood outstanding against his name to the Corporation. In such c ircumstances, petitioner submitted letter dated 16.05.2011 before the respondent No. 3 withdrawing his resignation letter dated 16.03.2011 and requesting the sa id respondent to allow him to join his duty. As no decision was taken, petitione r submitted representation dated 21.05.2011 to the Principal Secretary to the Go vernment of Assam, Co-operation Department (respondent No. 1) requesting him to direct the Corporation to take immediate action on his application dated 16.05.2 011. Thereafter, respondent No. 3 passed the impugned order dated 25. 9. 07.2011 stating that in view of non-repayment of dues by the petitioner, such am ount would be adjusted from his service benefits payable on resignation and that he was released from the service of the Corporation w.e.f. the date of his tend ering resignation i.e. 16.03.2011 as accepted vide order dated 06.04.2011. 10. Aggrieved, petitioner has preferred the present writ petition se eking the reliefs as indicated above. 11. Petitioner has contended that order dated 06.04.2011 cannot be s aid to be an acceptance of his resignation in as much as it was conditional. Sub ject to clearance of the pending dues, it was stated that the resignation of the petitioner was accepted. Since petitioner could not re-pay the outstanding dues and withdrew his resignation by letter dated 16.05.2011, there was no resignati on in the eye of law and, therefore, the impugned order dated 25.07.2011 releasi ng the petitioner from the service of the Corporation w.e.f. from the date of re signation is of no legal consequence. 12. it petition. This Court by order dated 24.08.2011 had issued notice on the wr 13. Respondent Nos. 2 and 3 have filed counter affidavit. Stand take n is that the Corporation had accepted the resignation of the petitioner w.e.f. 16.03.2011. The amount due to the Corporation had been adjusted from the amount payable to the petitioner and he was released from service w.e.f. 16.03.2011 by order dated 25.07.2011. Resignation tendered by the petitioner on 16.03.2011 was accepted by orders dated 06.04.2011 and 25.07.2011. Once the resignation is acc epted, that cannot be withdrawn. The resignation of the petitioner was not condi tionally accepted on 06.04.2011. In fact, petitioner was directed to repay the d ues which he failed to do. Accordingly, the said amount had to be adjusted from the dues of the petitioner on his release from service. It is further stated th at the Assam State Warehousing Corporation (Staff) Regulation, 1989 (Regulation) provides for a notice period for an employee to resign but considering the requ est of the petitioner, his resignation was accepted from the date sought for by the petitioner himself. The Regulation also prohibits employees of the Corporati on from indulging in political activities who cannot have affiliation with any p olitical party. Without informing the Corporation, petitioner had become a membe r of a political party.

Legal Reasoning

The petitioner in his reply affidavit reiterated the contention 13. that acceptance of his resignation by respondent No. 3 was conditional and such conditional acceptance is no acceptance in the eye of law. Corporation had no au thority to adjust his liabilities against his duties without his consent. Releas e of the petitioner after withdrawal of his resignation is invalid. 14. Mr. H. K. Mahanta, learned counsel for the petitioner submits th at the order dated 06.04.2011 cannot be construed to be acceptance of the resign ation of the petitioner in as much as it was conditional. Acceptance of resignat ion was made subject to repayment of the liabilities by the petitioner. Therefor e, such conditional acceptance is no acceptance in the eye of law. As a matter o f fact, petitioner could not repay the liabilities. When the condition could not be fulfilled, the conditional acceptance did not materialize. Thereafter, Petit ioner withdrew his resignation by submitting application dated 16.05.2011. In su ch circumstances, release of the petitioner from the service of the Corporation by deducting his liabilities from his dues vide order dated 25.07.2011 is illega l and nonest in the eye of law. Referring to Section 7 of the Indian Contract Ac t, 1872, learned counsel submits that acceptance has to be absolute and unqualif ied. He also places reliance on a decision of the Hon’ble Supreme Court in the c ase of Chand Mal Chayal Vs State of Rajasthan reported in (2006) 10 SCC 258. The submissions advanced by Mr. Mahanta have been resisted by Mr 15. . L. P. Sharma, learned counsel appearing for the Corporation. He submits that p etitioner had indulged in political activities despite the bar under the Regulat ion. His resignation was duly accepted by the authority and when he failed to re pay the liabilities, the Corporation decided to clear the liabilities from the s ervice benefits of the petitioner that would be due to him on his release from s ervice because of his resignation. He further submits that petitioner had contes ted the Assembly Election and only thereafter he sought withdrawal of his resign ation. Mr. Sharma contends that there is no merit in the case of the petitioner and therefore the same may be dismissed. 16. Submissions made have been considered. 17. Short point for consideration is whether the order dated 06.04.2 011 can be construed as complete and effective acceptance of resignation from se rvice of the petitioner? Corollary to the above issue would be whether withdrawa l of resignation by the petitioner on 16.05.2011 and release of the petitioner f rom service by order dated 25.07.2011 are legally tenable? 18. Since the entire issue relating to voluntary resignation of the petitioner from the service of the Corporation hinges on the order dated 06.04.2 011, a brief dilation on the said order is considered necessary. Decision

O R D E R Perused the application dated 16th March, 2011 of Sri Kusum Kuma r Mahanta, Warehouse Manager, Gr-II, Assam State Warehousing Corporation (ASWC), Head office (F&A branch), Guwahati-5, tendering resignation from the services o f the Corporation w.e.f. 16.03.2011, which has reached the undersigned on 25th M arch, 2011. It appears that, Shri Mahanta has not issued 2 (two) months noti ce in advance in writing to the ASWC for leaving the service of the Corporation as required under Regulation 14 (i) (c) of the Assam State Warehousing Corporati on (Staff) Regulation, 1989. Moreover, records reveal that, he has CPF advance o f Rs. 16,640.00 (Rupees Sixteen thousand six hundred forty) only in ASWC Employe es’ Contributory Provident Fund Trust and also another personal loan of Rs. 79,5 95.00 (Rupees Seventy nine thousand five hundred ninety five) only in Central Ba nk of India, Dispur branch, Guwahati for which the ASWC issued undertaking to th e concerned Bank to repay the monthly loan installment through salary deduction. In view of the above, resignation tendered by Sri Kusum Kumar Ma hanta Warehouse Manager, Gr-II, Assam State Warehousing Corporation is accepted subject to repayment of the abovementioned advance/loan amount and clearance of dues/liabilities towards the Corporation as may be applicable. AWC. 688/99/Estt/115 Date:06.04.2011 (cid:29) A careful reading of the said order would indicate that petition 19. er did not issue 2 (two) months notice in writing in advance to the Corporation for resigning from the Corporation as required under the Regulation. As per the said order, petitioner had liability of CPF advance of Rs. 16,640.00 and a perso nal loan of Rs. 79,595.00 in the Central Bank of India, Dispur Branch, Guwahati in respect of which the Corporation had given undertaken to the concerned Bank t o repay the monthly loan installments through salary deduction. It was in that c ontext that the resignation tendered by the petitioner was accepted subject to r epayment of above liabilities. 20. The 2 (two) months notice period as required under the Regulatio n was necessary to settle the outstanding liabilities of the petitioner. As the notice was not given, petitioner was given the option to repay the liabilities a nd subject to such repayment, his resignation was accepted. 21. Thus, the acceptance of resignation of the petitioner was made d ependent on repayment of the liabilities by the petitioner. As the petitioner co uld not repay the liabilities, it cannot be said that the acceptance of resignat ion became effective. 22. As such, petitioner was well within his right to withdraw his re signation letter dated 16.03.2011 vide his letter dated 16.05.2011 and the relea se of the petitioner effective from his date of resignation i.e. 16.03.2011 vide the order dated 25.07.2011 would therefore be of no legal consequence. 23. Reliance placed by Mr. Mahanta, learned counsel for the petition er on Section 7 of the Indian Contract Act, 1872 is however misplaced. The accep tance referred to in that section relates to entering into a contract and to for m a valid contract, the offer and acceptance of the offer must be absolute and u nqualified. The same is not the position in the present case where the petit 24. ioner sought severance of his relationship with the Corporation by way of resign ation. Be that as it may, as re-stated by the Apex Court in Chand Mal C 25. hayan (Supra), it is well settled principle of law that an incumbent is entitled to withdraw his resignation before acceptance. Resignation from service is a voluntary act of an employee. He m 26. ay choose to resign with immediate effect or from such date with notice, if the employer agrees to the same. Just as the act of resigning has be clear, unambigu ous, complete and effective, the acceptance of such resignation must also disclo se the above traits, namely, the acceptance must be clear, unambiguous, complete and effective. Until the resignation becomes effective, it would be open to the employee to withdraw his resignation. In the instant case, as already noticed above, order dated 06.04 27. .2011 does not disclose a complete and effective acceptance of resignation. It w as made dependent on fulfillment of a condition. Since the condition could not b e fulfilled, petitioner was well within his right to withdraw his resignation. I n such circumstances, petitioner could not have been released with effect from t he date of submission of resignation letter i.e. 16.03.2011 vide the order dated 25.07.2011 when he had already withdrawn his resignation on 16.05.2011. 28. With regard to the objection of the Corporation that petitioner had indulged in political activities, which is prohibited under the Regulation, the Court is of the view that it is a matter of discipline and conduct and would not have a bearing on the issue raised in the present proceeding. 29. Considering the above, impugned order dated 25.07.2011 is hereby set aside and quashed. Respondents are directed to allow the petitioner to rejo in service in the Corporation. 30. order as to cost.
