Mr. B. B. Gogoi, learned Addl. Public Prosecutor. Perused the case diary. The allegation made in the F.I.R. lodged by the husband of the petitioner No.1 i s that the petitioner No.1 and her sister, who are petitioners in this case, too k away money and some ornaments along with some articles during his absence. Mr . Konwar, learned counsel appearing for the petitioners has submitted that the p etitioner No.1 i.e. the wife lodged a case under Section 12 of the Protection of Women from Domestic Violence Act, 2005 on 1.2.2012 and thereafter, as a cover, the husband of the petitioner No.1 i.e. the informant, has falsely lodged the F. I.R. on 22.2.2012. Copy of the petition filed under Section 12 of the Protectio n of Women from Domestic Violence and the order dated 18.2.2012 passed by the le arned Chief Judicial Magistrate, Sivasagar support the contention of the learned counsel appearing for the petitioners. In view of the above and considering the entire aspect of the matter and the nat ure of the allegation, I do not find sufficient reason requiring custodial inter rogation of the petitioners. Therefore, the interim order dated 16.3.2012 passed in this case is made absolute subject to the condition indicated above. Return the case diary. The bail application is disposed of.
