The petitioners, namely, Sri Biraj Changmai @ Santasil and Sri Tultul Ch etia @ Bhaiti, have filed this application under Section 438 Cr.P.C. praying for granting them pre-arrest bail in connection with Sivasagar P.S. Case No. 398/20
Operative part
From the perusal of the case diary and other evidences so far collected by the I nvestigating Officer of the said Sivasagar P.S. Case No. 398/2013, several incri minating materials have been found against the petitioners and their involvement in the crime. Considering the above, this Court is of the opinion that it is not a fit case to grant pre-arrest bail to the aforesaid petitioners and accordingly, their pre-a rrest bail application is rejected. The petitioners are hereby directed to appear before the concerned I/O of the sa id Sivasagar P.S. Case No. 398/2013 by 03.10.2013 for recording of their stateme nts. In terms of the above, this pre-arrest bail application of the petitioners stand s disposed of. Return the case diary herewith.
