HON’BLE MR. JUSTICE C.R. SARMA Heard Mr. N.N. B. Choudhury, learned counsel appearing for the petitioner. Also heard Mr. B.B. Gogoi, learned addl. P.P., Assam, appearing for the State respo ndent and Mr. B.D. Konwar, lerned counsel appearing for the informant. Perused the C.D. and the concerned Cheques as well as the withdrawal receipts pr oduced by the lerned Addl. P.P. By this application filed under Section 438 Cr.P.C. the petitioner, namely, Sri Sunil Dutta has prayed for pre-arrest bail in connection with Teok P.S. Case No . 203/2013 under Sections 420/406/468 IPC. The matter relates to illegality committed in the allotment of houses under the IAY Scheme. It has been alleged that the houses have been allotted to other persons deprivin g the actual beneficiaries. The statement of the accused person has already been examined by the investigating agency. In view of above considering entire aspect of the matter, I find no necessity fo r custodial interrogation of the petitioner. Accordingly, the interim order dated 23.08.2013 is made absolute subject to cond ition that the petitioner shall appear before the Investigating Officer within 7 days from this date or on such other dates as may be so required for the purpos e of investigation. Return the C.D. The bail application is disposed of.
